Jan, 31) JUDGMENT OF $225 FOR PLAINTIFF IN BOWMANVILLE CASE Wage Action Between Wor- den and Savage Tried in Port Hope Judge Huycke, of Peterboro, has given judgment as follows in the action of Worden v, Savage from Bowmanville, tried by him last week in the county court, Mr. M. G. Gould for tho plajn- tit; Mr. FF. D, Boggs, K.C., for the defendants. Action tried at Cobourg Jan. 17, 1930, Since then I have read the exhibits filed as requested. Suit to recover wages. The plain. tiff alleges contract to pay him $60,00 per month. The onus is on him to establish the contract and amount claimed thereon, which onus he has failed to meet. The dofendant, William Savage, alleges a specific contract that plaintiff agreed to work for him receiving such compensation as sald defend- ant could afford, or found it con- venient to pay. To show this the onus is similarly on him which onus he, too, fails to meet, On the other hand I find the plaintiff did work es clerk, or as- sistant manager, in the Bowman House for six months and about one week, T can Tind no specific bargain made out but for such services there is an implied con- tract to .pay, and the amount not being fixexd I must allow a reas- onable sum or quantum meruit. The evidence does not render such assistance 'as I could wish in ar- riving at a proper sum. That of the witness Charles Dickinson is the most important and convine- ing, and indicates value to the ex- tent claimed $60.00 a month, On the ohter hand fault is found not 80 much for lack of ability or ef- ficiency, as for lack of attention and faithfulness. I must consider the evidence and the whole evi- dence. I find $50.00 per month as a proper allowance.
