DEALS ARE "GAMBLING DEBTS" So Ruled an lllionois Circuit Court in Recent Case Chicago, Ill, Sept. 9.--Board of trade deals are "gambling debts," an Illinois circuit court has ruled in a case now before the appellate court --a decision which may be of great importance in the financial world. It concerns the legality of con- tracts. between customers and mem- bers of the Chicago board of trade for purchase and sale of grain and provision futures, bids subsequently resulting in speculation. William McCabe, a farmer, was sued by James K. Riordon, a mem- ber of the board, to foreclose a mort- gage and recover on two notes for a total of 55,000, given in settlement of losses for alleg$ed speculation on the oard. McCabe held that the notes were given to satisfy gambling debts and asked for their cancellation. _ Decision of the lower court, should it be affirmed, places on board of trade firms the duty of investigating the need of. each customer for the grain and provisions he « orders, his nancial ability to accept and pay for all contracts, and his intention to make delivery or to receive shipment and not to close out before expiration of the option or maturing of the fu- ture contract. Counsel for McCabe contends that board of trade contracts as to do a le- gitimate business. He held that the volume of transactions by McCabe drew from the market, involving more than 27,000,000 bushels of grain, should have convinced the board that he was not engaged in le- gitimate business.
