In discharging the jurors, the judge said that he could not see how they could have arrived at any verdict oth- er than an acquittal, . ¢ Tunney was charged with having assaulted the girl on the night of 20 MINUTES That's all. Testifying yesterday in his own de- fence, Tunney claimed previous in- timacy with the young woman, Police Criticize In his address to the jury, His Lordship declared that he had not been satisfied with the evidence of Sergt. Tom Kirk, of the county pa- lice, with respect to a certain ques: tion bearing' on the charge which Tunney, the defence contended, had asked the officer. As to Constable O. J. Smart, who had accompanied Kirk in making the arrest, the judge re- marked: "You know how much help he was. to us in this case, He may have been telling the truth but he is not very intelligent." Kirk secured a written statement from the girl accusing Tunney and from the prisoner a statement in which the latter made damaging ad- missions. On the witness stand, Tun- ney claimed that the statement did not express properly his meaning. Regarding the statement, His Lord- ship said; "Because it has been ad- mitted in evidence against him, that does not in fact make it conclusive evidence against him, if he says that this statement, signed by him, does not properly set out what he said or meant to say to the officer." A few years ago there would have been no question about it. Skating and its associated game of hockey would have been given the decision. Times have changed and the Natural Resources publication says: "Ski-ing is un- doubtedly Canada's most popular outdoor winter pastime and year by year the number of its devotees steadily grows." { There has been much written as to whether skating has to take second place to the Norwegian pas- time in popularity among Canadi- ans and many writers have ex- pressed the opinion that the steel blades are steadily giving place to runoers of ash and hickory, Some have foreseen in this a dearth of hockey players in future because a person has to be an outstanding skater before he can be of much use in chasing a puck, However, many of the young people both ski and skate Certainly the scnoo) rinks where hoekey starts are still a big attraction and neariy all the youngsters who throng them also are fairly proficient on skis. "The great sport of ski-ing," says the Natural Resources circu- lar, "has the immense advantage that it can be enjoyed in a leisure- ly or strenuous fashion as the par- ticipant desires, and on that ac- count almost as many past the age of forty as under are among its de- votees, Although all may not be- come proficient in the art of ski- jumping and consequently quite a number turn out to watch these displays of skill and daring, there are no spectators at a ski hike or cross-cocntry run when novice and expert each derive 2a maximum of enjoyment from the outing. However, the craft of skiing does not end with the advility to travel quickly over the snow, fascinating as that is, but just as the expert skater goes on to greater devel- opment of his skill, so the earnest student of skiing has before him the technical side of the pastime and scores of difficult feats." While snowshoeing is still use- ful in many occupations it has sur- rendered absolutely to ski-ing as a sport. Bobselighs and tobog- gans are- also losing in popularity hefore the Norse pastime, Ottawa Was one ski club with 2,200 members which is claimed to be 'the largest in the world and it is estimated that there are 10,000 active skiers in the Capital. They mostly hike in the Gatineau Hills north of the city. The rolling [Laurentian country near Montreal makes skiing a great sport there and the city of Quebec is famous for its ski-trails and slides. Many of the smaller towns of Ontario and Quebec also have growing clubs. Out in the Rockies and Selkirks ski-ing has been popular i for years and the carnivals there, {at Banff and Revelstoke, are world | famous. This winter more people are fol- | lowing the ski trails than ever be- fore, They got an early start in this region; considerable snow fell about the first of December in , East Ontario and Quebec. However, {mild weather interfered later but with the turn of the year more (snow came and the hills were soon thronged with boys and girls, men and women, rushing along the , trails, dodging the trees and doing breath-taking turns.
