The Township owns the land and the building of the ma- rina located on the Port Perry water front, and has leased it operator John Mackie for the last three years. The dispute between the Township and the operator is about whether the lease agree- ment calls for the operator to WY the property taxes, about 4,000 annually. A recent judgement hand- ed down in Divisional Court said the operator is not liable for payment of the property tax- es. Township council, after meeting "in camera" with the municipal lawyer handling this case, agreed to launch an ap- peal of that decision to the Su- preme Court of Ontario. The Divisional Court de- scribed the wording of the lease "ambiguous" as to whether the operator is liable to pay the property taxes. Scugog Mayor Howard Hall said the council believes the wording in the lease is clear and councillors want the matter dealt with in a higher court. He also pointed out that Scugog must pay Durham Re- gion and the School Boards about 75 per cent (as their share) of the taxes on that prop- erty each year. The Mayor said that con- sidering the lease is now three years old and has another seven to run, the sum of money is con- siderable for the municipality. A date has not yet been set to start hearing the appeal in court.
