Lackner of Barkley St., Toronto a peared before the Provincial 0 ences Court last week to plead not- guilty to a charge of careless driving. Sergeant Ken Hudson, Durham Regional Police, ar- resting officer, was the first wit- ness for the crown. A vehicle approached from behind him at a high rate of speed with high beams on, and passed him on a corner, with double white lines, continuing toaccelerate. Officer Hudson was travel- ling at 110 km/h on his way to answering a silent alarm in Blackstock. He picked up pace with the vehicle and clocked himself at 135 km/h while the vehicle continued to pull away. He proceeded to follow the vehicle, and observed the car being "flashed" by drivers com- ing westbound as an indication to turn off the high beam lights. The vehicle did not re- spond, but continued to pull away. Officer Hudson came upon the vehicle just over the em- bankment with a flattened tire. From the fred s gravel and flattened grass, it ap- peared that the car had slid off the road while travelling around the corner because of excess speed. Lois Lemiere was called as a witness for the crown, she cor- roborated Officer Hudson's ac- count of the car travelling at high speed with its' high beams on, The defendant argued that he was not travelling as quickly as the Officer indicated, but that his tire blew out as he went around the corner, which dragged him into the ditch. Justice Harris determined that the evidence shows that Mr. Lackner was driving with- out due care and consideration. He found him guilty of careless driving and fined him $250.00. The Justice was unable to determine the "points" penalty as that falls within the jurisdic- tion of the Ministry of Trans- portation and Communication and he has no say in the matter.
