"We (council) have an obligation to the residents of Honey's Beach who have been using this (access) for a long time,' said Ward I coun- cillor Yvonne Christie. But she ad- ded that the dispute over access could very well end up in court. The suggestion to allow the residents access over the right-of- way was made by area councillor Harvey Graham who also said that if the legal owner of the land or the property owner adjacent to the right-of-way want to challenge the Township's position, the council will go to court, if necessary. Jim Geer, a spokesman for the newly formed Honey's Beach Association, led a delegation of about 20 property owners who are asking for the help of council to assure they retain access to the beach. Mr. Geer said after the meeting he hoped the decision by council would solve the problems. Essentially, cottagers and residents of the Honey's Beach *< subdivision have form many years been using a vacant lot as access to the sand beach on Lake Scugog. Some believed their-deeds gave them legal access across the lot and it was also believed the Town- ship owned the lot. However, at the end of April, the lot was sold and the new owner immediatly started to build a house. When the dispute over ac- cess first surfaced, the Township lawyer looked into the matter and concluded that Scugog has a legal right-of-way over the ten foot wide strip for such things as drainage requirements or fire fighters to run pumps and hoses from the lake in the event of an emergency. What is not clear, according to the Township lawyer, is whether this Township right includes the right for the-public to walk over the land to get to the waterfront. The only way to determine that issue one way or another would be to have it tested in a court of law. Members of council hope that doesn't happen. 'At a meetng of council two weeks ago when the issue was under discussion, the current owner of the right-of-way indicated whe was not completely opposed to the residents using the access to the beach, but she was concerned about the safety of children while the house is in the construction phase. Mr. Geer told the council that young children who use the beach are always supervised and that in- cludes the walk to and from the: beach. Owner will co-operate to make building conform The owner of an office building which was moved last week from Queen Street to an un-serviced lot on Shanley Street near Water Street says he's willing to co- operate fully to satisfy all municipal requirements. Paul Fletcher had the office building moved May 19 from its former location beside the Port Perry IGA store to the new location at the .un-improved por- tion of Shanley Street. He plans to use part of the building for a law office and rent the remainder for commercial office space. However, there are no sewer, water or hydré connection to the building -where it is now, and on Monday afternoon, several mem- bers of Township council were WZ very annoyed that the building is sitting on an un-serviced lot. "He (Mr. Fletcher) should not have been allowed to move the building until the services were ready", said Ward 2 councillot Howard Hall. "And he should not be allowed to leave the building sit- ting there." Township administrator' Earl Cuddie told the meeting the municipality will not issue a building permit to allow the-struc- ture to be set on a foundation until the services are in place and the un-improved portion of Shanley Street is up-graded to Township standards at no expense to the municipality. "We (Township) are going to pursue this with.as much vigor as pussible, "said Mr. Cufidie to the council. ~ Mr. Fletcher was not present in the council chambers when the matter came under discussion, but he told the Star later that evening he doesn't want to get into a fight with the municipality. He said he plans to apply for a building permit on May 26, and if necessary, he's prepared to bring the services to the building before the permit is issued, if that's what the municipality demands. He said he has. contacted Durham Region about sewer and water services and he will pay the full cost if other lot owners on that portion of the street don't want to contribute.
