2 -- PORT PERRY STAR -- Tuesday, Sept. 10, 1985 At Stephenson's Point Road Township council is expected to make a decision at its next regular meeting on a request for nine further lots at the Stephenson's Point subdivision proposal on Scugog Not on (From page 1) in jeopardy. And he said that in- formal discussions he has had with other municipalities in the Region indicate the request from the Board of Education is not going to get the support of the local councils in Island. The council has given the green light to 13 lots in the project, but a of homeowners in the area has asked the Ontario Municipal Board to turn it down. ballot those jurisdictions. The request to the local council came following a 10-5 vote at a meeting of the Durham School Board late last month. Scugog trustee Rev. Stewart McEntyre put forward the motion to ask the local councils to include the question on the referendum. No decision on nine lots The nine lots requested at Monday's meeting were part of the original proposal presented to council last fall. Lawyer Michael Fowler, acting for the developers, noted that since an OMB hearing will be held for 13 lots, it would be "in the best in- terest of everyone' for the hearing to include the nine additional lots. He specifically asked council for a zoing change to Shoreline Residentail with a holding designation, which he said, means that council favours development, but only after all technical and other requirements had Appeal court cuts jail sentence Wayne and Randy Kennedy have had their sentences reduced by an appeal court from nine to seven years, and will be eligible for parole next year. The two brothers, formerly from Seagrave were sentenced to nine years in jail for their part in the killing of Clare- mont farmer Duncan Spang, 72, in December, 1982. A third person, Ronald Perrault, also from Seagrave was sentenced to life in prison for his role in the killing. There was no appeal of the sentence handed down last year to Perrault. The request for the holding designation came as a surprise to lawyer Tony Kelly, ac- ting on behalf of Stephenson's Point property owners who are objecting to any new development along the road. And Mr. Kelly noted that if the developers want to take the full 22 lots in front of the OMB, they should appeal the council decision of last May which in effect granted 13 lots, but tur- ned down the additional nine. Ken Murphy, a property owner opposed to the development pressed council for a definition of "shoreline residential' zoning, sin- ce none of the nine lots in fact touch the shore of the lake, but are back lots on the opposite side of the road. Although a group of property owners has been adament in its ob- jections to the proposed development, the Town- ship received letters of support from seven ratepayers stating they would have no objec- tions if proper planning proceedures are followed. Mayor Jerry Taylor, who is a financial par- tner in the proposed development with David Haynes, declared a con- flict of interest prior to the discussion and left the council chambers until that portion of the meeting was complete.
