The statue was erected in memory of a Port Perry man who achieved fame by founding the practice of Chiropractic. An Ontario Municipal Board (OMB) hearing that could cost Durham Region millions of dollars in revenue from development charges will likely be held in Whitby "starting on October 17. The OMB will be asked to 'rule on a challenge from Paramount Development Corporation Ltd. that region- al development charges are unfairly high. Similar cases have been heard by the OMB in other parts of Ontario and have generally resulted in sub- stantial reductions in the development charges. The charges or lot levies are funds the developers must pay municipalities. to cover the cost of works and administration for their building projects. Paramount is being asked for $520,600 in lot levies for a 190-unit subdivision the firm plans to build on the east side, of Anderson Street and Manning Avenue in Whitby. The charge per unit is $2,740. Ted Phelps, vice- president of planning at Paramount, says his firm is not trying to get the levies eliminated, only reduced. "We don't object to levies, but our analysis shows it has become a source of revenue for the region." ~~ Phelps said of the $23 million in lot levies the region has collected between 1974 and 1979 about half is held in cash reserved. He - said this "strongly suggests" the region has collected about twice the lot levies it should have. In a case similar to the one Paramount has referred to the OMB, a develppment firm's challenge of Peel Region and Brampton's lot levies resulted in the OMB ruling the charges be reduc- ed by almost $1600 per unit. The Peel Region lot levy was reduced from $1,985.96 per unit and the city's charg- es were reduced to $500. The OMB ruling has been appealed to cabinet and a decision is expected in a few days. Although Phelps said the --date for the hearing was this week tentatively set for Oct. Phelps said that although Paramount has not asked that Whitby's lot levies be referred, to the OMB, he indicated the company was talking with the town to get them reduced. In 1979, the region collect- ed $5,159,670 in lot levies. If the lot levies are cut, that figure could drop dram- atically, especially with the building slowdown. However, there has been no ruling yet as to'whether a municipality, forced to reduce lot levies in one case by the OMB, must reduce them in all cases.
