TAKE NOTICE that the Council of The Corporation of The Town of Whitby intends to apply to The Ontario Municipal Board pursuant to the provisions of Section 35 of The Planning Act for approval of By-law No. 568-77 passed on the 12th day of September, A.D., 1977. A copy of the By-law is furnished herewith. A note giving an explanation of the purpose and effect of the By-law and stating the lands affected thereby is also furnished herewith. ANY PERSON INTERESTED MAY, within twenty- one (21) days after the date of this notice, send by registered mail or deliver to the Clerk-Administrator of The Town of Whitby notice of objection to approval of the said By-law or any part thereof and shall indicate that if a hearing is held the objector or an agent will attend at the hearing to state the objection. ANY PERSON wishing to support the application for approval of the By-law may within twenty-one (21) days after the date of this notice, send by registered mail or deliver to the Clerk-Administrator of the Town of Whitby notice of his support or approval of the said By-law together with a request for notice of any hearing that may be held giving also the name and address to which such notice should be given. THE ONTARIO MUNICIPAL BOARD may approve of the said By-law but before doing so it may appoint a time and place when any objection to the By-law will be considered. THE CORPORATION OF THE TOWN OF WHITBY BY-LAW NO. 568-77 Being a By-law to amend By-law Number 2585 WHEREAS the Municipal Council of the Corporation of the. Town of Whitby deems it advisable to amend By-law Number 2585; ' NOW THEREFORE, BE IT ENACTED AND IT IS HEREBY ENACTED as a By-law of the Corporation of the Town of Whitby by the Council thereof, as follows: - (1) That Section 7(1) (g) of By-law 2585 be and the same is hereby repealed and the following is substituted therefor: i 7(1)(g) INTERIOR SIDE YARD: Minimum width 4 feet PROVIDED THAT the minimum width of any portion of the yard abutting any portion of the second storey of any building or structure shall be 6 feet AND PROVIDED FURTHER THAT the mini- mum width of any portion of the yard abutting any portion of the third storey of any building or structure shall be 8 feet NOTWITHSTANDING the aforesaid, where no garage or carport is provided on the lot, the minimum width of one interior side yard shall be 14 feet. (2) That Section 7(2) (g) of By-law 2585 be and the same is hereby repealed and the following is substituted therefor:- 7(2)(g) INTERIOR SIDE YARD (on the side of the dwelling house that is not attached to the adjoining dwelling house): Minimum width-4 feet PROVIDED THAT the minimum width of any portion of the yard abutting any portion of the second storey of any building or structure shall be 6 feet AND PROVIDED FURTHER THAT the mini- mum width of any portion of the yard abytting any portion of the third storey of any building or structure shall be 8 feet NOTWITHSTANDING the Aforesaid, where no garage or carport is provided on the lot, the minimum width of one interior side yard shall be 14 feet. i (3) That Section 25(19) (¢) (ii) (h) of By-law 2585 be and the same is hereby repealed and the following substi- tuted therefor:- 25(19)(c) (ii) (h) INTERIOR SIDE YARD Minimum width 4 feet PROVIDED THAT the minimum width of any portion of the yard abutting any portion of the second storey of any building or structure shall be 6 feet AND PROVIDED FURTHER THAT the mini- mum width of any portion of the yard abutting any portion of the third storey of any building or structure shall be 8 feet NOTWITHSTANDING the aforesaid, where no "garage or carport is provided on the lot, the minimum width of one interior side yard shall be 14 feet. (4) That Section 25(19) (d) (ii) (h) of By-law 2585 be and the same is hereby repealed and the following sub- stituted therefor:- 25(19)(d) (ii) (h) INTERIOR SIDE YARD (on the side of the dwelling house that is not attached to the adjoining dwelling house): Mini- mum width 4 feet PROVIDED THAT the minimum width of any portion of the yard abutting any portion of the second storey of any building or structure shall be 6 feet ; AND PROVIDED FURTHER THAT the mini- mum width of any portion of the yard abutting any portion of the third storey of any building or structure shall be 8 feet - NOTWITHSTANDING the aforesaid, where.no garage or carport is: provided on the lot, the minimum width of one interior side yard shall be 14 feet. (5) That Section 25(28) (¢) (ii) (h) of By-law 2585 be and the same is hereby repealed and the following sub- stituted therefor: - 25(26) (¢) (ii) (h) INTERIOR SIDE YARD: . Minimum width 4 feet PROVIDED THAT the minimum width of any portion of the yard abutting any portion of the Secor storey of any building or structure shall 6 feet AND PROVIDED FURTHER THAT the mini- mum width of any portion of the yard abutting any portion of the third storey of any building or structure shall be 8 feet NOTWITHSTANDING the aforesaid, where no garage or carport is provided on the lot, the minimum width of one inferior side yard shall be 14 feet. (6) That Section 25(26) (d) (ii) (h) of By-law 2585 be and the same is hereby repealed and the following sub- stituted therefor:- 25(26) (d) (ii) (h) INTERIOR SIDE YARD (on the side of the dwelling house that is' not attached to the adjoining dwelling house): Minimum width 4 feet PROVIDED THAT the minimum width of any portion of the yard abutting any portion of the second storey of any building or structure shall be 6 feet , AND PROVIDED FURTHER THAT the mini- mum width of any portion of the yard abutting any portion of the third storey of any building or structure shall be 8 feet ; rida NOTWITHSTANDING the aforesaid, where no garage or carport is provided on the lot, the minimum width of one interior side yard shall be 14 feet. (7) That Section 2(19)(0) of By-law 2585 be and the same is hereby amended so that the section will be as follows: 2(19)(0) "SPLIT LEVEL DWELLING HOUSE" " means a dwelling house in which the first floor above finished grade is so constructed as to create two or more different levels, the vertical distance between all levels of such dwelling house being always less than a full storey. (8) That this By-law shall come into force on the date it is passed by the Council of the Town of Whitby subject to the approval of The Ontario Municipal Board. EXPLANATORY NOTE Purpose and Effect of By-Law Number 568-77. The purpose and effect of By-law Number 568-77 is to amend Restricted Area By-law 2585 in the following manner: (1) To repeal those provisions presently relating to interior side yards for single-family detached dwell ings and semi-detached dwelling housés and to replace same with those included in the by-law. The effect of the new provisions will allow greater architectural flexibility in the design of multilpe storey dwellings while at the same time maintaining adequate space for building maintenance, rear yard access and day lighting. (2) To amend Section 2(19)(0) to read as contained within the by-law. The effect of the amendment is to increase the minimum interior side yard requirements for a split level dwelling in order to increase the area for building maintenance, and day lighting.
