Ward pleaded not guilty before Magiistrate Hind through his counsel, J. P. Mangan, Ward was arrested yesterday, after information was laid hy Mrs. Annie Ennis that he was behind considerably in his rent. It was found out later, however, that Ward had paid $20 on account and was intending to pay the re- mainder within a stipulated time. Mrs, Ennis on the other hand, then wished to have the case with- drawn. Both charges were withdrawn, Ward paying the costs of the prose- cution in the charge of false pre- tences. R. W. English, the man from whom Ward had borrowed $100 in order to purchase an automobile, stated in court this morning that Ward had paid $40 bn the nolo ue held, and said that he would pay the rest of the pote hefore the end of the week, when the note expired. The auto in question was pot purchased by Ward. In dismissing the charges again- st Ward, His Worship made spe- cial mention of cases of this kind, for which full convicting evidence is very much lacking. 'The time of the court and the time of the crown attorney are taken up with arguing a case which should never have been brought to the atten- tion of the poliice," said His Wor- ship. Wanted By the Cormwall Police on a Similar Charge --He and Leo Craig Were Acquitted in a $3,000 Clothing Store Robbery Here (By Staff Reporter) Whitby, Sept. 11.--Lewis Beaver and Leo Craig, Toronto, charged with stealing $3,000 worth of men's clothing from the store of Canning Bros, clothiers and furn- ishers, 14 King gtrect west, Osh- awa, were discharged this morning when Judge J. E. Thompson rul- ed that the Crown's evidence was not sufficient to establish a case against them. Beaver's liberty, however, was short as immediately after receiving his release he was placed under arrest by Chief of Police Gunson, who acted on re- quest of the Cornwall Police wha want him on a similar charge. The accused men were defended by A. N. Gurofsky, of Toronto, well- known criminal lawyer. Neither of the accused showed any concern during the trial which was short and lasted little more than an hour. They received His Honor's ruling without any out- ward manifestation although rela- tives attending the hearing scem- ed much relieved. On addressing the prisoners, Juduge Thompson pointed out that the Crown had given sufficient evidence to point toward themselves the finger of suspicion. He advised that in fu- ture they conduct themselves so that the police would not be fore- ed to regard them with distrust. Previous to announcing his de- cision, His Honor gave a short re- view of the evidence and pointed out that there was little against Craig or Beaver. They might or might not be guilty but he did not see that there was anything disclosed in court to prove that either man had committed the of- fense. Suspicion was not enough to give ground for conviction and he therefore determined that a case had not been established.
