Question of Ownership There are nine questipns submit- ted to the court but what is con sidered the crucial one is whether, when the Dominion Government constructs, on a waterway, works for the purposes of navigation, and power is concentrated thereby to whom does the surplus power, over and above what is needed for the operation of the navigation works belong. Is it to the Dominion or the Province? The Dominion Government argues that under such circum- stances it owns the surplus power while the provinces, conceded to own the heds of the rivers and claiming the water which goes over the heds, hold that, when the Do- minion uses such surplus electric energy ,the province is entitled to be compensated for it.
