Whithy, June 16.--Jjoseph Heard, local garage and cartage man, was fined and costs and allowed sus- pended sentence when convicted by Magistrate Willis at police court yes- terday afternoon on a charge of as- saulting a police officer while dis- Sarging his duty. It is alleged that shot after' noon, on Wednesday, the accused struck Provincial Officer Taylor, of Oshawa, on the chin after the latter had stopped his car while driving 'south on Brock street and asked him to show his operator's license. Heard, who was represented by W. H, Kennedy, local barrister, pleaded not guilty and told the court that in all his sixty-seven years he had mever struck a man. According to the evidence given the provincial officer first noticed Heard as/the latter entered the high- way in a truck from a lane leading to his farm which is situated north of the town limits. The defendant is said to have made a wide turn forcing Taylor to pass on his wrong side. The "officer, who is a plain- clothesman, testified that he signi- fied for Heard to stop but he kept on going south towards the town, 'Tay- lor stated"that he then followed hi in his own car keeping abreast o him and a pted to draw attenti to his badge while calling out tha was an officer of the law. ae John street intersection the constable claimed that the defendant had .to draw up on account of*traffic. The constable said he then showed the defendant a pair of handcuffs and had him drive to the police station where Chief Gunson was called, Heard being released a few minutes later. Clarence Simpson, an employee on the Heard farm, who was driving in the truck at the time, stated that he noticed Constable Taylor was re- questing them to stop but failed to realize that he was a police officer, until he had mounted to the running board and displayed his badge. He did not see his employer strike a blow but saw him waving His hand, Immediately after he left to go to dinner. The defendant alleged that when he first saw Taylor on the highway, the officer was traveling at seventy- five miles an hour. Blanche Christie, a young woman, who was arrested during the raid on the boathouse, also pleaded guilty to a charge of keeping a disorderly house and was sentenced to six months in the Mercer penitentiary at Toronto.
