Sciscione told the court he checked Hyde's vital signs in the back of an am- bulance at which point he said he noticed "an alcohol- smelling odour" coming from Hyde. When he asked about this, court heard Hyde told Sciscione he'd had a couple beers with lunch. Hyde denied any drug use that day, said Scis- cione. The court heard the pre- vious day that Hyde had been taken to a breath tech- nician at the Oakville po- lice station, but testing found he had a blood-alco- hol content of zero. When asked by Pa- quette if he asked Hyde about his medical history, Sciscione said Hyde told him he had a history of blacking out, heart mur- murs and high blood pres- sure. Under cross examina- tion by Paquette, Sciscione also testified that Hyde was responsive to questions, provided appropriate an- swers to these questions and was not difficult to un- derstand. When asked if he no- ticed a marijuana smell coming from Hyde, Scis- cione said he did not. Those present also heard from Halton police Const. Scott Kennedy who took photos of Hyde's de- stroyed vehicle. One photo focused on a white cigarette found on the driver's side floor. Const. Kyle Davis testi- fied the previous day that a marijuana cigarette had been found in the vehicle. Kennedy told the court he detected the smell of marijuana inside the vehi- cle. He also took photos of items in the vehicle's trunk, which included sev- eral full and empty beer cans and a small bag con- taining a green leafy sub- stance. Kennedy said he only took the photos and there- fore could not testify as to what the substance in the bag was. Godinho also filed an agreed statement of facts. This statement noted there was no dispute be- tween the Crown and the defence that Hyde was in the driver's seat of the red Nissan when it struck and killed Whiten. It also stated a post-mor- tem examination had been conducted, which found that Whiten died from mul- tiple blunt force injuries that were not survivable. The statement further conceded that Hyde's vehi- cle had been inspected and no issues were found that would have contributed to the collision. The report said that fol- lowing Hyde's arrest, a sample of his urine was sent to the Centre of Foren- sic Sciences for analysis. The findings of that analysis will be provided later in the trial.
