In the case of the Limited Interests in Perpetuity (Permanent Easement - Watermain) for the purposes of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purpose of site works on, upon, under, over, and through the lands for and in connection with facilitating the construction, installation, inspection, testing, verification, repair, replacement and/or operation of municipal underground sewers, underground water lines, drains, drainage courses, beddings, pipes, conduits, markers, channels, ducts, valves, valve chambers, fittings, meters, hydrants, manholes, services, fixtures, equipment and other associated works and appurtenances or accessories thereto whether or not similar to the foregoing in relation to the transfer, transmission, control, flow, carriage, conveyance, transportation, increasing or decreasing velocity or volume of municipal sewage or water or both, and for all things necessary or incidental thereto including physical modification to the lands through site clearing, building demolition, improvements removal or reconstruction, underground tunnelling, digging, grading, ditching, trenching, filling or otherwise, as well as, to enter and occupy the lands with all necessary vehicles, machinery, equipment, workmen, and other materials required for or related to the Wyecroft Road Construction and Extension and works ancillary thereto ("Permanent Easement - Watermain") 3. In the case of the Limited Interests in Perpetuity (Permanent Easement - Storm Sewer Outlet), for the purposes of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purpose of facilitating the construction, installation and maintenance of drainage works including, but not limited to, the installation of a storm sewer outlet system including ditches, swales, storm water management ponds and other material, grading, access for the construction and/or reconstruction, repair and maintenance of the drainage works, bridges, swales, storm water management ponds and ditches ancillary and necessary to the Wyecroft Road Construction and Extension in the Town of Oakville and works ancillary thereto ("Permanent Easement - Storm Sewer Outlet") 4. In the case of the Limited Interests in Perpetuity (Permanent Easement - Roadside Embankment) for the purposes of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purpose of site works on, upon, under, over, and through the lands for the purpose of providing access for construction and maintenance of an earth cut/fill slope embankment (slope and drainage swale at the top of the embankment) supporting Wyecroft Road and in connection with installing, keeping, operating, maintaining, inspecting, patrolling, altering, moving, replacing, reconstructing, enlarging, extending and repairing municipal infrastructure, drainage courses, drainage swales, erosion control measures, sediment control devices, slope stability works, equipment, and other materials required for or related to the Wyecroft Road Construction and Extension and works ancillary thereto ("Permanent Easement - Roadside Embankment") 5. In the case of the Limited Interests in Perpetuity (Permanent Easements - Hydro Poles, Tiebacks, Guy Wires, Swing Space) for the purposes of a free, uninterrupted and unobstructed permanent easement in gross or rights in the nature of a permanent easement in gross to enter, occupy and re-enter by all Authorized Users, including, but not limited to, servants, agents, employees, contractors, sub-contractors and workers, with all necessary material, including, but not limited to, vehicles, machinery, supplies and equipment at all times in, on, over, through, under, above, along and upon the lands for the municipal purpose of facilitating the construction, installation, maintenance and repair of associated public utilities including aerial and/or subsurface hydro lines, tiebacks, poles, anchors, guywires, swaying and swinging of overhead hydro lines and associated materials and equipment including utility relocation and site grading ancillary and necessary to the Wyecroft Road Construction and Extension in the Town of Oakville and works ancillary thereto ("Permanent Easements - Hydro Poles, Tiebacks, Guy Wires, Swing Space"). 6. In the case of the Temporary Limited Interests (Temporary Easements - Construction Access) for the purpose of a free, uninterrupted and unobstructed temporary easement in gross or rights in the nature of a temporary easement in gross for a term of six (6) years upon the commencement of construction and terminating no later than June 30, 2028 for the purpose of entering and re-entering by all authorized users including, but not limited to servants, agents, employees, contractors, sub-contractors, representatives and workers with all necessary material including, but not limited to, light and heavy vehicles, service vehicles, boring machines, machinery, mobile cranes, supplies, support facilities and equipment at all times in, on, over, under, through, along and upon the lands for all construction related purposes, including, but not limited to, ingress and egress, grading, drainage, excavation, storage of equipment, supplies, parking of vehicles or other equipment, site clearance, including all necessary removal of vegetation, trees, relocation, and all works necessary or related to the Wyecroft Road Construction and Extension, together with works ancillary thereto ("Temporary Easements - Construction Access"). registered in the Land Registry Office for the Land Titles Division of Halton (No. 20), for the municipal purpose of facilitating the Construction and extension of Wyecroft Road Road from Burloak Drive (Regional Road 21) and Bronte Road (Regional Road 25) in the Town of Oakville, (the"Wyecroft Road Construction and Extension"). NOTICE IS HEREBY GIVEN that application has been made for approval to expropriate lands and interest described in Schedule"A"set out herein. Any owner of lands in respect of which notice is given who desires a hearing into whether the taking of such land is fair, sound and reasonably necessary in the achievement of the objectives of the expropriating authority shall so notify the approving authority in writing a. in the case of a registered owner, served personally or by registered mail within thirty (30) days after the registered owner is served with the notice, or, when the registered owner is served by publication, within thirty (30) days after the first publication of the notice; b. in the case of an owner who is not a registered owner, within thirty (30) days after the first publication of the notice.
