Justice Edward Mor- gan, who ruled on the case, appeared to agree the mea- sures were too restrictive. He argued the conserva- tion plan and related by- laws freeze the property as a golf course, contrary to the wishes of the property owner. "There is nothing in the Ontario Heritage Act or otherwise in provincial legislation and policy that empowers a municipality to require a private busi- ness - whether it is a ceme- tery, a farm or a golf course - to keep running as a busi- ness. The Conservation Plan for Glen Abbey stands alone in that regard," said Morgan in his decision. "For the impugned by- laws to ignore the econom- ic impact on the property owner, and to effectively require a property owner not only to maintain its property, but to stay in business, all for the benefit of other residents of the town, is to reflect bad faith decision-making. And the community-spirited inten- tions of town officials and council in enacting these measures provide no de- fence."fence."f Morgan also slammed the conservation plan and related bylaws as too vague to survive chal- lenge. This case will appear before the Ontario Court of Appeal on May 23. This is the second Glen Abbey related matter the Town of Oakville has brought to the Ontario Court of Appeal. On Nov. 5, 2018 council voted unanimously to pro- ceed with an appeal of an Oct. 25 decision by the On- tario Superior Court of Justice that stated Clu- bLink has the right to bring forward an applica- tion to demolish Glen Ab- bey. The town rejected Clu- bLink's demolition appli- cation on Feb. 12, 2018 and argued the company could not appeal the decision to the Local Planning Appeal Tribunal because of the golf course's designation under the Ontario Heri- tage Act. This appeal will be heard by the Ontario Court of Appeal on May 21. NEWS JUDGE SLAMS CONSERVATION PLAN AS TOO VAGUE TO SURVIVE CHALLENGE Continued from page 34
