During the day's pro- ceedings town lawyers again rejected arguments made by ClubLink that the town had thrown legisla- tion together at the last minute to block their pro- posed development. "What we are doing is ... protecting the zoning," Sa- hi is quoted as saying. Barton also questioned ClubLink's attempt to move their project forward through the Superior Court. She noted that following Glen Abbey Golf Course's designation under the On- tario Heritage Act Clu- bLink had 30 days to appeal the matter to the province's Conservation Review Board. She said ClubLink did not choose that route. ClubLink officials said they did not appeal to the review board because its decisions are not binding on the Town of Oakville. "There is no dispute Clu- bLink did not exercise their right to object because they didn't like the process that would flow from that objec- tion," said Barton. "They see this as a way of getting around that pro- cess." During the hearing Jus- tice Edward Morgan asked about how - if ClubLink lost its appeals - they would be required to seek approval to renovate the golf course or introduce new designs. He voiced concerns the Ontario Heritage Act would require them to maintain an antiquated golf course. King noted the act only requires ClubLink to get consent from the town if they plan to make changes that would impact the prop- erty's heritage attributes.
