The one law should apply to all promotions, and this is what is contemplated in the proposed *‘*Sate of Securities Act."‘ Much more than this was underâ€" stood to have been planned, but those intgrested in mining will not find any special fault with the Act as it is at present understood. Mining ventures will be as ready as anyother line to come under any. measure that will promise protection for the public. That was the weak spot,â€"the enforcement. There always seemed to be difficulty in gny authority making a move. Péer haps the new law will overcome this vital weakness. If so, it will be a good law. The new law provides for the appointmént of a Commissioner of Securities, and gives that Commisâ€" sioner very wide powers. If he proves as fair and as efMicient as the Mining Commissioner, for instance, then it is very probable that the ‘‘Sale of Seâ€" curities Act 1922"‘ will prove both populax"mnl useful.. License all sellers of securities so as to place them directly under the supervisionâ€" of the Commissioner of Securities appointed under the Act. Give the public fuller information in prospectuses. Prevent extremely large profits on stock sales. § Stop the advertising of flotations that are under suspicion. The Cofumissioner is to be satisfied that everything is all right before a flotation is allowed and that a reason.= able proportion of the money to be seâ€" cured is to go into development of, operation of the company. There is no certificate issued, so the Govern. ment does not in any way appear to be behind any of the ventures, but the flotation can not go on if the Goâ€" vernment (as represefited by the Comâ€" missioner) is not satisfied. The Commissioner has. powers to stop the selling or advertising of shares about which he finds dishonest or extravagant claims are made. If the advertising is too flamboyant the Commissioners ‘has authority to stop it. ~ Newspapers are not allowed to run the advertisements of any stock disâ€" approved by the Commissioner. â€" Fraud is defined by the Act as ‘‘{any fictitious or pretended sale or purâ€" ’('lmse, any promise, representhtion or prediction as to the future not made in good faith, and the gaining or atâ€" tempting to"gain & cmmnissio‘p, fee or profit so large as to endanger the solâ€" | veney of thhmomrise. f Sure thing the Commissioner ‘has wide powers., And if, and when, the Auvt becomes law, it miay be said that its helpfulâ€" ness or otherwise will depend to a very large @degree upon. the personâ€" ality of the Commissioner.
