He was defended > by C. W. Bell of Hamilton. After Crown Attorney Brennan had made a most stirring address to the Jury, he closed his case. Mr. Bell then opened up for the defense by dropping what might be ‘called â€" a ’bomb-shell into the court. He made a most strenuous objection to the case going on and backed up his obâ€" jection by the citation of legal authâ€" ority on the matter. His objection was to the effect that all the records of the proceedings in the magisâ€" trate‘s court were not produced in this court. The missing documents ‘being the original information that had been laid against St. John, and uponé which he had been given ‘\his preliminary hearing in Grimsby. Mr. Bell examined no witnesses nor proâ€" duced any witnesses for the defense, opening his case and basing his claim for acquittal entirely upon the grounds that no case could . be. made out without an information being produced in court. It was not there.‘ His Honor held that the point was well taken, and the jury was dismisâ€" sed and the prisoner discharged. Immediately upon the closing of the perjury case ‘Crown Attorney Brennan shattered the quietude of the court by producing _ another charge against St. John, being that of "assaulting a police officer‘". Mr. Bell lost his poise for a few momâ€" ents over this sudden turn of affairs. He immediately claimed that he did not know anything about this newl case and could not very well go on with it, as he had no knowledge of it at all. After a consultation among the crown officials, the case was laid over until the June session of the court. TLON Another important change is that candidates for election in townships must now file declaration of qualifiâ€" cation before election, the same as candidates in cities, towns and vilâ€" lages. This also applies to candiâ€" dates for trustees in police villages and toâ€"school trustees in urban muni cipalities, where the election is by ballot. The declarations of qualification are to beéefiled on nomination day, or before nine o‘clock in the evening of the following day, in the office of the clerk of the municipality. That the Niagara peninsula â€" fruit growers will have little to fear for in the marketing of their fruit next year is the opinion of many promiâ€" nent fruit men. Since the meeting called by the Department of Agriculâ€" ture about three weeks ago, at which a committee was appointed to formu late the demands of the district in the marketing of fruit, considerable progress has been made. Several meetings of the subcommittte have been held and while there is no inform ation being given out by the comâ€" mittee it is understood that when the generai meeting of fruit growers is called a most interesting report will ‘be presented. UP TO THE GROWERS Whether there will be a coâ€"operâ€" ative association formed as a result of efforts of the committee, lies enâ€" tirely, Major Roberts of GRIMSBY, asserted, with the growers, who will be invited to the general meeting. The representatives are of the opinâ€" ion that the growers want it, and are working with this idea in view. The association, should it materialize, will be so constituted as to deal with all matters that directly or indirectly effect the production and marketing of fruit.
