Father Killed Woman on South Grimsby Farm - Son Gets $6,250 From His Estate.
Mr. Justice D.P.J. Kelly last Wednesday granted a judgment of $6,250 to John Ivan Podwinsky, R.R. 3, Smithville, against the estate of his father, William Podwinsky, who killed the plaintiff's wife with a hammer on Dec. 19, 1950, and then hanged himself in the barn.
The action was taken by Podwinsky against the Premier Trust Co., as administrators of the estate. Mr. Justice Kelly found the father responsible for the death of his daughter-in-law and granted the judgment of $6,250, including funeral expenses. Podwinsky had sought $15,000, plus $250 for funeral expenses.
The elder Podwinsky had been released the month prior to the incident from a mental hospital. While Mrs. Podwinsky was milking the cows in the barn, he struck her on the side of the head with a hammer. She died while being rushed to hospital in Hamilton.
In granting judgment, Mr. Justice Kelly instructed that $2,750 be paid to the plaintiff for his loss and expenses, $750 to each of the three youngest children, $500 to each of the next two children, and $250 to the eldest.
