The city is seeking $31 million from Ford for his role in the RIM Park financâ€" ing fiasco, which added more than $33 million to the cost of the 500â€"acre recreâ€" ation facility. Even more concerning to a local citiâ€" zens‘ group that pushed for the litigation is the revelation that Ford has been denied coverage by the city‘s insurance provider, even though he sought protecâ€" tion under the city‘s past insurance policy which expired June 1. Robert Fleming, the head of Waterloo Watch, the group that encouraged city council to consider filing suits against former city officials, including past city councils, said they pushed the city to name more than one person in the suit out of concern that coverage could be denied to Ford because of some of the "willful acts" he admitted to during the RIM Park inquiry. Those acts include failing to check the numbers on the financing scheme pushed by MFP Financial Services Ltd. officials before Ford recommended that city council approve the deal in Septemâ€" ber 2000. Waterloo soon found out that instead of getting a interest rate of 4.73 per cent council agreed to, they were paying a rate of more than nine per cent. Fleming said. that in itself could be grounds for the insurance provider to deny coverage under the previous policy, because willful acts aren‘t covered under that or any other agreement. And without the insurance coverage for Ford, there is no way the city will be able to recover the $31 million in extra financing costs, as well as the costs of the RIM Park inquiry.
