Lawâ€"setting cases will help % establish ground rules for Young Offenders Act Catherine Miehm Chronicle Staff The Young Offenders Act may be causing problems in some areas of the country, but police in the Waterloo region have had few problems adapting. It has been almost two months since the new act was fully implemented, replacing the 77â€"vearâ€"old Juvenile Delinquents Act. Brenneman said that police officers have attended training seminars to familiarize themselves with the new act and some policy guidelines have been published "to help them use the act the way it should be used." "I think we‘re coping extremely well," said Sgt. Herb Brenneman, head of the Waterloo Regional Police Department‘s youth bureau. "It‘s new so everyone is a little reluctant at first but once an officer has handled one case he‘s got it under his belt and he‘s OK from then on." "There are more responsibilities now with respect to the rights of the young person,"‘ he said. "Officers have to make it clear when arresting a young person that they have the right to counsel and they also have the right to have their parents there as well. That has to be made clear." While the local police have not had any real problems with the new act, Brenneman ackâ€" nowledged that there are areas where problems could easily arise. People in this age group were considered adults under the Juvenile Delinquents Act but they are classified as young people in the new act. As such, they can only be tried in a youth court where the maximum penalty for any crime is three years imprisonment. -..;\.s‘ vllélâ€"l:gtl{;i:fe;ltity of anyone under the age of 18 cannot be made public. S _ *"There‘s a chance that someone under 18 could be armed and dangerous and in such a case we can‘t notify the public," Brenneman said. Because 16 and 17â€"yearâ€"olds have been given a category of their own under the new act, Brenneman predicts new departments will have to be created to deal with them. A "It‘s sure created a problem for the correctional people," he said. ‘"They have to have all these separate facilities for this group because they can‘t be placed with the adults_anymore.“ L ul t dbhob inatibiicceahen insy There are some conflicts within the act that Brenneman believes will have to be studied. For example, it is now mandatory that the parents of any 16 or 17â€"yearâ€"old who has been arrested be notified. w‘:'l.!u-t' we have a lot of kids out on their own who don‘t want their parents notified," he said. ‘"Often they haven‘t been living at home for quite some time." “-K;well as being contacted at the time of arrest, parents could also be obliged to appear in court with their child. s m‘v‘.l.t ;w"i-l-lâ€"i)e up to the youth court to decide if they should proceed without them," Brenneman said. Brenneman believes potential problems which could arise from the section of the act prohibiting the charging of anyone under the age of 12 are minimal. Under the Juvenile Delinquents Act, only children under the age of 7 were exempt from criminal charges. "We rarely arrested anyone under 12 before," Brenneman said. ‘"Most are petty offenses like shoplifting or breaking a window. The volume has been very low." _ He éiï¬lained that the police are not powerless in dealing with offenders under the age of 12. . "A lot of people are under the impression that if the kid is under 12 you can‘t do anything,"‘ he said. "That‘s not true. We can‘t charge him, but we have the authority to arrest and detain him." _ Brenneman feels this authority is effective enough when dealing with children. _ 80 vlf a kid that iée is taken back to his parents by a guy in a uniform, it usually scares him into behavâ€" ing." _ There are potential problems inherent in the new act, but Brenneman feels they will not be insurâ€" mountable. e "If a troublesome child is protected by the Young Offenders Act, you can always try charging him under some other act â€" the Mental Health Act or something," he said. w‘.‘-i{ge“;;-icr'l' mind that it‘s very new and hasn‘t really been tested.
