Friday, March 26,1999 THE OAKVILLE BEAVER 47 Accepting a conditional offer Today's home seller should anticipate that an offer for their property may be conditional upon certain activities that benefit the buyer. An offer that is con­ ditional upon the sale of the buyer's exist­ ing home can have a major impact on the transaction. Before such a conditional offer is accepted, you should know what you're getting into. While a conditional offer is in place on your property, you are still free to continue marketing your property to other prospec­ tive buyers. This keeps the heat on your buyer to make every effort to fulfill their condition in the shortest possible time. You cannot accept another conditional offer while one is in force. However, if your salesperson has arranged for an "escape clause" in the agreement, you will still be able to accept a firm offer provided you give your conditional buyer the option of "firming up" their offer first. If your condi­ tional buyer does "firm up" their offer, they are simply removing their conditions. The original selling price and terms of their offer stay in effect, regardless of what you may have been offered by another party. Be aware that sales representatives will generally be less likely to show your prop­ erty if a conditional offer is in place. They may be reluctant to get buyers excited about a property that someone else has "first call" on. An effective way to promote your property during this period will be using tactics such as Open Houses. Don't rely on the MLS system, where representa­ tives may "weed out" conditional sales before arranging to show properties to buy­ ers. When reviewing a conditional offer, ask the expert.
