In its preamble, the motion refers to former Ward 5 candidate Mike Bugala‘s previous call for an audit of Huffman‘s campaign expenses â€" a request that was ultimately denied by the compliance audit cornmittee. The resolution also claims that Bugala and some members of council "have received more information from reliable sources that implies that Councilior Huffman may have filed a false declaration of campaign expensâ€" es form and misled the members of the comâ€" pliance audit committee." In addition to a compliance audit, Malboeuf is requesting the appointment of an outside solicitor to investigate the new allegations. When the Champion asked Malboeuf for further details on the new information he‘s referring to, he said, "Out of respect for my colleagues, it would not be right for me to diâ€" vulge that information in the media prior to our dealing with the motion at council." The funds from thirdâ€"party contributors paid for Huffman‘s promotional campaign material produced by a Mississaugaâ€"based printing company during the 2014 election campaign. Inâ€"kind donations are contributions whereby instead of giving money, goods and services are paid for. Of Huffman‘s contributors, three donors each paid $750 towards printing costs â€" the maximum allowed under the Municiâ€" pal Elections Act (MEA) â€" while the other two paid $600 and $619.10, respectively. During the July 2015 meeting of the Joint Election Compliance Audit Committee, Huffâ€" man explained that his contributors made cash payments directly to the printing comâ€" pany, which he said was "perfectly legal." Bugala cited sections 69 and 70 of the MEA, which state all contributions of goods or serâ€" vices are to be documented and accounted for at market value. The Act also notes that no cash contributions exceeding $25 can be made or accepted on behalf of a candidate. Since the amount in question was for goods and services, the committee deemed it to be a "grey area," denying the request for an audit. Bugala appealed this decision to the Ontario Court of Justice.
