N. â€"O. engine that was backing out of the Hollinger yards. Arthur Bruneau on| the way home from work at the Meâ€"| ntyre had in the car with him Real deCouer, Fred Adams, Emmett Mcâ€" Nulty, Frank Holden and A. Sabourin. Evidence in this case was given by the filagman at the Hollinger crossing, the engineer and brakeman of the T. N.O. engine, by Steve Stefanich, Daiâ€" ton bus driver. The flagman told about. flagging the bus from Timmins and cars coming from Schumacher, He said he had gone out far enough on the road for the cars to see him. Thse bus and two of the cars stopped but Bruneau‘s car came on and collided with the enâ€" gine. The engineer and brakeman exâ€" plained that when the gate was opened they had right of way across the road because there was a flagman at the crossing to stop oncoming traffic either way. They both had twentyâ€" three years with the T. N. O. Railway and knew the rules and regulations They had lived up to the rules and regulations fully in this case. The Bruneau car must have disregarded the _fiagman to come along as it did. The engine was stopped as soon as it was seen that there was going to be an acciâ€" dent. The bus driver told of coming along the road and seeing the fiagman signal. Anyone coming either way could see the flagman, he said. All the witnesses for the prosecution were closely examined by Solicitor Al. Wetmore for the defence. Defence witnesses included a mech anic who examined the car after th accid@nt, and several of those in th car at the time of the accident. Th mechanic said that the blalees were i pretty good condition when he exam ined them. Bruneau said he did no see the flagman and, that a pile of san hit the backing enging. He said he di not see the gate either. The first h knew that a train was coming. Wa when Sabourin told him. He decide to turn the car and run parallel wit the track with the idea of stopping i the space allowed him. However, Sa bourin grabbed the wheel and this pla was accordingly upset. Other occu pants of the car gave somewhat sim{ lar evidence, to the effect.that the saw no flagman and that the drive had to avoid the accident as best h could.
