TIESMAGAMI Dec. 31â€"The legal acâ€" tion over th»~» as=>ssment of the resiâ€" dence here of A. R. Swaynse, T. N. O, agent at Temagami can be distinguishâ€" ed from a similar case at Cochrans some years ago in two respects, it is held by Juige J. A. S. Plouffe of the District Court of Nipissing, who outâ€" lines these in the course of his findâ€" ing on an appeal by Mrs. Swayne and in his setting out of the stated case asked for in the disoute. His Honour‘s ruling, in which he holds that the agent is exempt from taxation on the ground that he cccupies the house in his caâ€" pacity of servant of the Crown, has been received by the trustees of the public school section the cther party to the dispute. Referring to the from the Cochrane case, in which that municipâ€" ality and A. T. King, station agent for the T. N. Q., there were involved, Judge Ploufle states that the disâ€" tinguishing features are that in Temâ€" agami there has bren no parting of possession or contrcl of the premises by the Crown, because the right to inâ€" spect has been maintained and ex°râ€" cised by the T. N. O. as owner and secondly, that the agent was "bound by command to ozrcupy the said premises by a person in authority." At Cochrane it was held on appsal through a stated case that Mr. King was assessiable. His residence is in the court house section of Cochrans, whil> where Mr. Swayne lives in a house on station property. THURSDAY. JANUARY 2ND, 1941 Mr. G.
