ALL the wires of the said Party of the First Part used in the sarid works within the Township of Tisdale, shall be insulated and shall be worked on Metallie Cireuit and all material to be used by the said Party of the First Part in their works on streets, lanes, bridges, highways, squares, and pubâ€" lic places in the said Township of Tisâ€" dale, may, be inspected by and shall be subject to the approval of the Council of the said Township or some person appointed by the said Council for that purpose "4. The Parsy ‘of the First Part shall indemnify and save harmless, the said Township from and against all damages, loss suits, claims and costs, to person or property, caused by the negligence on the part of the Party of the First Part, their servants or Agents in conncctlon with the erection and operation of the poles, awvires or other apparatus of the Party of the First Part, in the said Township of Tisdale. of the poles, wires or other apparatus of the Party of the First Part, in the said Town of Timmins. 9. Whe said Party of the First Part shall use only such poles in the conâ€" struction of the said works, on streets Township as shall be nearly as possible Town, as shall be nearly as possible straight and perpendicular, and beâ€" fore any poles are erected, the posiâ€" tion of the poles shall be approved by the Council of the said Township of Tisdale, or by some person appointed by the said Council for that purpose. The Council of. the said Township of Tisdale shall have the right to order the Party of the First Part to move during each year cof the Franchise heleb) given, not more than five poles, in which case said poles shall be moved at the direction of the Council, at the expense of the Party of the First Part. ‘7. The said.Party of the First Part shall not in the construction, erection and maintenance of the said works unduly or unreasonably interferewith the right of travelling or using the streets, lanes, squares, bridges, highâ€" ways and boulevards, curbs, sideâ€" walks, or other public places or any water course.of the same, and the enâ€" trance of all ~doors, gateways and bridges, shall be kept free and unâ€" obstructed and lights, barriers . or watchmen, shall be provided and kept by the Party of the First Part during the construction and repairs of the saidsworks for the protection and safety of the Public using the said Streets and other places. at their own expense, during the said. time for and at the times herein set: forth, light and keep lighted the said Street Lamps with Electricity. 5. The Electrical System and Apâ€" pliances of, and the current as supâ€" plied by the Party of the First Part shall be in all respects of first class quality and efficiency, and equal in quality and efficiency on an average to those installed and operated in other towns in Ontario, provided that the Reeve of the Township, or any member of the Fire and Light Commutâ€" tee of the Council or any person apâ€" proved by the said Council, shall have the privilege to inspect the plant, inâ€" struments and appliances in conneeâ€" tion with the said system for the purâ€" pose of ascertaining that the electrical current being supplied is of the effiâ€" ciency and power above provided for. 6. The said Street Lamps, and each of them ishall be kept lighted every nigcht, from dusk to daylight. Or under THE PORCUPINE ADVANCE, TIMMINS, ONTARIO. 16. In case the supply of current shall be interrupted or fail, from the Act of God, the King‘s Enemies, ice or accident in any way, or for necesâ€" sary repairs to machinery or plant, or for any â€"other reasons whether of a similar or dissimilar nature, not atâ€" tributed to the neglect of the said Party of the First Part, the Party of the First Part shall not be liable for damages in respect of such interrupâ€" tion or failure, nor be considered in default, provided they use reasonable diligence to restore such supply, but a proportionate abatement shall be made in the amount payable under this contract hereinbefore provided for a time during which current is not supplied by reason of such interâ€" ruption, or failure of current. _ Proâ€" vided, however, should such supply of current be interrupted at any time for a period of thirty consecutive days or for thirty days in all, within any six months, then in either of such cases the Franchise in this Agreement contained shall at the option of the Party of the Second Part be terminatâ€" ed. 15. The Party of the First Part hereby agrees to supply 2200 volt, 25 cycle, 3 PWase alternating current to the Corporation of the Township of Tisdale for the operation of their sewerage disposal plant and pumping system. The charge to the Corporaâ€" tion of the Township of Tisdale for current for the operation of the said sewerage disposal plant and pumping system shall be at 3e. per kilowatt hbour in addition to a fixed charge of $1.00 per month per H.P. based on the name plate ratings of the motors, and for current for the operation of the said fire pump, 3e. per kuowatt hour. 18. In case any dispute or difâ€" ference shall avise between the parties hereto relative to any of the matters provided for in thw agreement, then such dispute or difference shall be submitted to the arbitration and deâ€" terminiwionâ€" of three arbitrators, one to be appointed by the Party of the 17. The Company resetves the right to make an additional charge to cover the cost of supplying the service when it is required for a period of less than one year, and also reserves the right to requlre deposits to guarantee the securing of the Company‘s accounts. If the Party of the Second Part at any time desires to supply the lamps required, for renewals, then â€"their prices shall be reduced by 10 per cent. The Party of the First Part will supâ€" ply the labour and attend to the changing of the lamps. And Lamps over 400 wattsand not exceeding 500 Watts, $60.00.per lamp per annum. _ â€"For lamps over 300 watts and not exceeding 400 watts, $50.00 per lam per annum. l For Lamps overâ€"200 watts and not exceeding: 300 watts, $40.00 per lamp per annum. 13. The said Party of the First Part shall not be permittedâ€"to discriminate against ‘any applicant in the Townâ€" ship of Tisdale applying for or usâ€" ing the Electricity, either as to supply. or price by reason of the smallness of Electricity applied for or used by the applicant or consumer, but shall be bound, provided the payment is made therefor actording to the term hereâ€" of, to supply and _ ¢o continue to supâ€" ply, any appliczmt\ih the said Townâ€" ship of Tisdale applying therefor or using the same who is not indebted to the Pafty of the First Part for Elecâ€" tricity previously supplied to such apâ€" plicant and whose premises are situâ€" ated not more than 300 feet from the digtribution line of the said Party of thX' First Part, without regard to the quantity of Electricity applied for, required or used by such applicant or consumer without discriminating in that ‘re®ect or as to the price or otherwise, however, except as hereinâ€" fore provided. R 14. The Street Lamps herein menâ€" tioned shall be lamps hereinafter mentioned, and the Township hereby covenants, promises and agrees to pay to the Party of the First Part, for the lighting of Streets, lanes, squares and other public places, according to the following schedule :â€" For each Lamp of 100 watts or less, $16.66 per lamp per annum. For Lamps over 100 watts and not exceeding 200 watts $30.00 per lamp per annum. 4 _~â€"12%. The said Party of. the First Part shall continue to supply Electric current according to the terms of this contract for ten years from the first day of ; A.D;, 19 and the Party of the First Part shall be bound, during the said time, to supâ€" ply electricity for light or ‘heat or power, to any applicants occupying premises within the Township of Tisâ€" dale and applying for the same and whose premises are situated not more than 300 feet from any distribution line of the said Party of the First Part, and who‘is â€"not indebted to the Party of the First Part for electricity previqously supplied to such applicant, and to continue to so supply the elecâ€" tricity, provided the same is paid acâ€" cording to the terms hereof. , H.P, and under 460 per Kilowatt hour. H.P.; cents ‘"Stating that he did fot desire to mix religion and politics and that his business was to preach Christ eruciâ€" fied, Rev. H. Cocks, rector of St. James‘ Anglican church, touched briefly on the prohibifionâ€"question in the course of his sermon last Sunday evening. The preacher made it clear that anything he said was his personâ€" al opinion only. He asked if the children had been taught good and right holy things would there have been any need for the O.T.A.% He felt that such things as the O.T.A. and government control were black eyes for the church, he said. _ Mr. Cocks declared that if they built up the right character in the children they would not need a hundred and one laws toâ€"keep them in the narrow road Throughout the serimon the preacher stressed the necessity of building character and he appealed to the congregation t6 stand behind the Sunday School, asking for addiâ€" tional teachersg there. Mr. Cocks based his sermon on the words of the old Greek philosopher \yxo declared that ‘‘as a man thinketh‘in his heart, so is he.‘" 3 Georzge Mcelintyre, a young man about 21 years of age, from Renfrew County, was instantly killed at the Keeley Mine, Silver Centre, on Wedâ€" nesday last week when his head was caught between the timbers and the cage. _ Another workman found the unfortunate young man dead on the floor of the cage. It would that who had been emâ€" ployed at the Keeley Mine for some five months past, had been down "on an errand to the new winze. Returnâ€" ing _ he had evidently given the sigâ€" nal to hoist, and apparently haa put his head out of the cage just as the cage started. _ His head and face were crushed and his neck was broken. Death was instantaneous. CRUSHED TO DEATH AT KEELEY MINE LAST WEEK. A Toronto newspaper recently sugâ€" gested that all the blergymen, with the exception of Rev. Canon Cody, are in favour of the O.T.A. This, of c@ourse, is not true. Elsewhere in this issue will be found a statement from Archbishop Thornloe that is much distance from favouring he O. T.A. Recently the rector of St. James‘ Anglican chureh at Cobalt alâ€" so preached a sermon that showed he was no enthusiast for the O.T.A. EV A.D. 1926. NOTICE REEVE Clerk. Mr. F. Trudell, of Haileybury, last week had his arm broken as well as received other minor injuries while at work at the O‘Brien Mine, Cobalt. He was working underground when some rock fell, evidently from the walls. He twas bruised about the face and head ard body, while apparâ€" ently a large piece of the rock struck his arm, which no dowhbt he used to shield his face and hbhead. His arm was fractured and he was hurt otherâ€" wise. He was taken to the Mines Hospital at Cobalt, and is making exâ€" cellent recovery, but will be laid up for some time as a result of the inâ€" juries received. FURNACE PIPES ON FIRE . CAUSE ALARM TUESDAY _At 7.10 Tuesday morning the fire brigade had a swift run in answer to an alarm turned in from Box 14. Mr. S. Fairbrother,; on his way past the Gioldfields Theatre was asked y the janitor to turn in an alarm, dense issuing from the basement of the theatre. The fire truck and b{igade were on the scene before the bell ‘had finished ringing the alarm. The smoke was found to be caused by the furnace pipes being on fire, and a few papers in front of the furnace door being ablaze. _ There was no danger in view of the fireâ€" proof construction of the theatre basement, while the prompt responsé to the alarm also added to the chanees for safety. The pipes were allowed to burn out and so clean themselves, while Fire Chief Borland and his men kept a watchful eye on affairs genâ€" erally. Many â€"remarked onâ€" the speedy response of the brigade, while others simply took the attitude that iz was the usual thing with the Timmins Brigade and so not a matter for comâ€" ment. However, it‘s a good thing, anvway.
