He did not know how the three tampered letters had gotten among the railway letters or how they had come to be in the condition deseribed. He had certainly not molested the letters in any way, he said. There Lad been several in and out of the baggage car during the trip, but he had not left the car where the mail box was. He had not seen anyone touching the mail or mail box. Reâ€" ference was made to the long service of the aceused in the employ of the railway without anything against him and his record of the best, but the Magistrate considered the evidence sufficient to commit the aceused for, trial before a higher court. O‘Toole, a wellâ€"known and highlyâ€"reâ€" garded employee of the T. N. O. Railway, who has been in the service of the road for some eighteen years, was committed for trial on a charge of tampering with mail matter. As baggageman on the run he had charge of the mail box and the charge against him is based on the fact that three letter posted on the train did not reach North Bay in the shape they were posted. The envelopes were torn and five dolilars was misâ€" sing from one of them. Instead of being with the other mail, they were with the envelopes for the railway offices at North Bay. The Crown emâ€" phazised the fact that the accused was the only one that should have access to the mail box on the run. Mr. O‘Toole denied all knowledge of any interference with the mail in any way. He could not remember the particular letters in question, but at the same time he could not deny havâ€"| ing receiving them, as there was much mail at that time of the year.
