On Feb. 11, 1999, teenager David Ellis was removing cookie dough from an industrial ribbon mixer, at New Sun Cookies on Speers Road, when the machine became activated. He was drawn into the mixer by the rotating blades and struck his head on the edge of the mixer. It was Ellis' second day on the job. Six days later he died of head injuries at Sunnybrook Hospital in Toronto. The owners o f the business, 1169711 Ontario Inc., pleaded guilty to failing to ensure that the exposed mov ing parts of the mixer were guarded, contrary to one section of the Act and a section of the Regulation For Industrial Establishments. Former supervisor Michael Peetz, of Waterdown, and supervisor Richard Bates pleaded guilty to the counts. The two are co-owners and directors of the company. Peetz was jailed for 20 days and Bates fined $7,500. The company was fined $62,500. for the infractions. When Justice John Takach of the Ontario Court of Justice in Oakville handed down the sentence, it marked the third time in Ontario that a jail term has been ordered for violations of the Act. The two previous occasions took place in 1993 and 1988. Ontario Labour M inister Chris Stockwell said the sentence was justi fied. "As thousands of students across the province start summer jobs, the court's decision is a clear message that all employers must take their health and safety responsibilities seriously," said Stockwell.
