Joseph Peter Amenta, of Oshawa, was scheduled to make his first appearance Wednesday in the Ontario Court of Justice on King Street West. Instead lawyer Michael Morse appeared on his client's behalf and told court Mr. Amenta is currently "bedridden and physically unable to come." He said Mr. Amenta underwent underwent major heart surgery two weeks ago and during the operation doctors discovered discovered "even more damage" than expected. Mr. Amenta was arrested Aug. 24 and charged with criminal negligence causing death to Veronica Belak, who was killed a block from her Berwick Crescent home while crossing Rossland Road at Waverley Street on Aug. 17. Durham Regional Police said the teenager was walk ing north in the crosswalk on a green light when she was struck by the eastbound van being driven by Mr. Amenta and thrown a distance of approximately approximately 60 metres. She was pronounced dead on arrival at Lakeridge Health Oshawa.
