AND TAKE NOTICE THAT any person or agency may appeal to the Ontario Municipal Board in respect of the by-law by filing with the Clerk of The Corporation of the Municipality of Clarington not later than the 16th day of August, 1994 at the address shown below, a notice of appeal setting out the objection to the by-law and the reasons in support of the objection. An explanation of the development charges imposed under the by-law, a description of the lands to which the by-law applies and a key map showing the location of the lands to which the by-law applies, are attached. Copies of the Maps contained in Schedules A-1, A-2 and A-3 of By-law No. 94-115 also are attached. The amendments to By-law No. 92-105 made by By-law No. 94-115 apply in respect of the lands located within a Benefiting Area shown on one of the Maps attached to By-law No.. 94-115 as Schedules A ; 1, A-2 and A-3, respectively. 2. By-law No. 94-115 adds certain designated services respecting which development charges are payable in respect of the development of lands within the relevant Benefiting Area. However, the by-law does not increase the amounts of the development charges now imposed by By-law No. 92-105 as amended. 3. The purpose of the amendments contained in By-law No. 94-115 is to authorize the Council of The Corporation of the Municipality of Clarington to enter into certain front-ending agreements under Part II of the Development Charges Act providing for an owner to make a front-end payment to cover the net capital cost of services designated in the agreement that are required to enable the land to be developed. The Development Charges Act provides that when a front-ending agreement has been made and comes into effect, the Municipality shall require a benefiting owner to pay that owner's portion of the front-end payment of the net capital cost of the installation of the relevant services as a condition of any approval granted during the term of the agreement of any development on that portion of the benefiting owner's land located within the Benefiting Area. This payment will be in addition to the payment of development charges imposed by By-law No. 92-105, as amended. (A further Notice will be given pursuant to the Development Charges Act of each front-ending agreement when it is made explaining its nature and purpose and indicating that it can be viewed in the office of the Clerk of the Municipality during normal office hours.) 4. The amendments contained in By-law No. 94-115: (i) add the Stormwater Management Works from the CPR Tracks to Apple Blossom Boulevard and the Stormwater Management Works from Concession Street to Soper Creek to the designated services respecting which development charges are payable in respect of the development of the lands within the Benefiting Area shown on the Map contained in Schedule A-1 ; (ii) add the Mann Street Storm Sewer Oversizing Works from Apple Blossom Boulevard to south of Concession Street to the designated services respecting which development charges are payable in respect of the development of the lands within the Benefiting Area shown on the Map contained in Schedule A-2; and (iii) add the Mann Street Road Reconstruction Works north of Concession Street, including storm sewers, road preparation, paving, curbs, sidewalks and sod to the designated services respecting which development charges are payable in respect of the development of the lands within the Benefiting Area shown on the Map contained in Schedule A-3.
