Sentence of two months in jail was imposed on James Winston Ferris, 31-year-old Dundas man, at the winter assizes of the Ontario Supreme Court held in Hamilton. Mr. Justice A.M. LeBel imposed sentence after Ferris was acquitted of manslaughter, but convicted of assault last week.
The charge was laid following the death of Clarence Henry Rushton, former Grimsby sportsman, who moved to Dundas to open a restaurant. In an argument over the price of a meal, Ferris and Rushton scuffled and Rushton died.
In imposing the two months' sentence for assault, Mr. Justice LeBel told Ferris he was lucky to escape conviction on a manslaughter charge. The more serious offence carries a maximum penalty of life imprisonment.
