fire to his splitlevel Brentwood Road home after it burned to the ground May 12 1976 No one was in the yearold house when fire broke out Brian Wakefield the first Essa Township volunteer firefighter at the scene near am testified Monday the fire behaved as though it containedsome kind of flammable liquid Wakefield professional Barrie firefighter said water which should have ex tinguished the flames instead had mushrooming effect The more water you put on it the higher the flames went he said He said the mushrooming effect made him suspect some substance was present in the fire which did not respond to water labelling the fire as Class fire one involving flammable liquids Wakefield testified he arrived at the Davey house after receiving call and found the fire contained to basement recreation room Attempts to douse flames through broken window only increased the intensity of the fire he said and the building was soon entire ly involved in flames Two hours later he testified the building was destroyed with spot fires continuing to erupt Wakefield estimated the fire began two hours before firefighters arrived saying one smouldering section had competely destroyed the dining room loor except for its joints He said the floor could not have been destroyed in the two hours firefighters were at the scene it would have had to smoulder for matter of hours he said Wakefield also said the basement fire could not have started the smouldering dining room floor fire because it was cut off by doors and other rooms It looked like the floor was completely gone before the basement most unusual arson trial witness He testified aspects of the Davey fire were unusual for residential fires saying the smoke was heavier than normal house fire smoke and the rapid spread of the fire wasnt normal PenetangMidiand Coach Lines employee first spotted the fire and aroused neighbours who called firefighters Ronald Grant testified he saw fire shooting out of basement window and used garden hose on the window with neighbours until firefighters arrived One neighbor Cathy Hlebka testified she had seen some unusual movement at the Davey house that night She said she saw halfton truck and car leave the Davey home at about 11 30 pm although no lights showed in the house She said the Daveys usually didnt return from their restaurant business in Angus before then and did not own halfton truck Crown attorney John Murphy told the five woman six man jury he intends to prove Davey set fire to his house under the crushing weight of heavy debts He said he plans to call insurance adjusters and evidence on Daveys mortgage to il lustrate his financial complications in addi tion to calling fire inspectors Murphy says his case against Davey is cir cumstantial based on number of incidents involving the fire and his financial situation that fit together to indicate his guilt He told the jury the crown is not required to show Davey had fraudulent intent in commit ting arson under the law although he con tinually stressed Davey was deeply in debt Through testimony Monday Murphy trac ed Daveys steps May 12 from cab ride to Barrie from his Brentwood Road business at 130am to his return at almost4am Barrie cab driver Roy Nunes testified when he drove Davey to Angus he commented on flashing lights in the Brentwood Road area and said Davey made no reply Nunes said Davey
