resident Lawrence Campbell says he doesnt plan to catch it committee went back to an earlier council decision to split the $780 repair bill evenly among the city Campbell developer Lou Kozloz after Kozlov refused city request to pay the whole shot Campbell said Tuesday he will probably appear before council next week to oppose the committee recommendation and if council goes through with the threeway split he will take the matter to small claims court Campbell is already out $200 deposit for city repairs to the sewer He said today he will not only refuse to pay the rest and sue for the return of his deposit if necessary but will also sue for about $150 in damages if the case goes to court Damages arise from backup which filled his base ment with sewage in May after the pipe broke he said City investigation of the May backup showed that Campbells lateral pipe was broken on city property under the street Cause of the break appeared to be large rock left in the fill after the pipe was installed The case was further coni plicated by the fact the city workmen dug in the wrong place the first time they at tempted to repair the backup thus increasing the bill Campbell was originally bill ed the whole cost of the job in keeping with city policy which makes each landowner responsible for his entire lateral pipe regardless of the property line However he pro tested the bill arguing that he should not be responsible for break on city property and that the pipe was obviously not pro perly inspected in the first place Council than agreed to three way split and got $25167 from Kozlov but when amp bell continued to protest council voted to go after Kozlov for the rest of the money Kozlov refus ed to pay and disclaimed any moral or legal obligation in the matter Committee votes down idea to buy 10 cityowned buses Ald Nelson Garrett lost another battle to get Barrie to buy its own new buses for the citys transit system And Ald Fred Ruemper is less than happy with the price the citys current transit operator has put on getting out of contract which forces the city to buy the operators used buses if it wants to contract the service out to different operator Travelways School Transit Stock BrotherS of Orillia has offered 1978 prices involving hike of about eight per cent over 1977 rates if the buy our used buses clause stays in the contract But contract
