The withdrawal from succession duties was promised several years ago as response to the imposition of capital gains tax on the increase in value of appreciable assets About 3012 per cent of the income tax payable by Ontario residents on capital gains is paid to the Ontario provincial government with the balance going to the federal govern ment As the provinces share of this capital gainstax has increased substantially since its imposition in 1972 it would appear that the province anticipates that it can now afford to withdraw its succession duties This withdrawal was no doubt ex dited by the fact that of the rest of the provinces only Que ec levies succession duties The exact impact upon the total death duties assessed against particular estate created by death occurring before or after April 10 1979 will vary significantly depen ding upon the size of the estate the type of assets owned and the relationship of the beneficiaries to the deceased An estate of $500000 consisting solely of life insurance principal residence exempt from capital gains and fixed dollar investments not producing capital gains would not be subject to capital gains tax whereas succession duties would have been levied on all these assets after the $300000 basic exemption was deducted In this instance the withdrawal of succession duties might result in reduction in death duties of approximately $50000 on assets passing to the deceaseds children If an estate of $500000 consists largely of appreciated capital assets the total death duties are likely to be unaf fected by this change In calculating
