Eegeflgegfleegemeg Legal aid officials check applicants carefully in attempt to keep cost down By SLE iiocrunn Examiner Staff Reporter Simcoe County legal aid of ficials try to eep the number of people getting aid down says area supervisor John Currie He says fewer applications have been approved in the last year although some lawyers and judges claim legal aid is responsible for part of back log in courts About 106 applicants were turned down last month before the involved process of check ing them out began says Mr urrie refused 37 per cent of the applications that came to me last month he says Simcoe ountys legal aid of fice issues 215 legal aid cer tificates month in Ontario the number reach ed 76062 in 1976 said Mr Cur rie and it cost Ontario tax payers $240 million The average number of applications refused provincewide is 311 per cent Of the 215 people in Simcoe Lounty nine could afford to contribute to their legal fees All the others could do was try to meet the programs monthly fee which is based on income Rates range from 33103125 Whether or not someone is eligible for legal aid depends on financial status says Mr ur rie Anybody can apply said Mr Currie but those who dont need it are weeded out He said those applying to go to the ministiy of community and social services on ollier Street and their monthly iii come and liquid assets are iii vestigated ll their income is less than their expenses says Mr ur ric they get legal aid lNTIllYPAYMENTS Once someone is eligible for legal aid and given cer titicate he has to keep up mon thly payments or legal aid is ctit said Mr Currie There are problems with the system he said There is no limit to the number of times people can ap ply for and get legal aid and there are repeaters number of One difficulty especially in the criminal areas is these young boys who get into trou ble spend few months in jail get out and get into trouble again says Mr Currie We cant limit the number one person could get but if we limit them to five or seven year it would present quite change in figures Legal aid also has to provide duty counsels in court to give people advice and thats another added cost and de mand on lawyers time There are seven fulltiine criminal courts in Simcoe County including two in Bar rie and seasonal criminal court in Wasaga Beach each summer Each one requires duty counsel and lawyers filling in as counsel get an average of about $26 an hour He says an average of 440 people see duty counsel each month Police announce in court that there is duty counsel available and that anyone who wants to see him should go to certain room said Mr Currie Sometimes there is quite lineup FIVE IIOL RS Duty counsels only put in five hours day however says Mr Currie because of thecost We have to have good reason to go any longer at that price The number of applicants has doubled since operations began 10 years ago says Mr Currie and most people know about it through advertising He says he tries to limit the number of cases going to trial to try and cut down applica tions No one under 18 years of age is eligible unless they have no family support he said People on legal aid cant get in front of judge and jury without his written approval and civil cases need an opinion submitted by the lawyer There are guidelines an area supervisor has to follow says Mr Currie but the final deci sion is generally theirs While the demand for legal aid is heavy 285 applications and an average 01 400 to sot in Inspector appointed Ontarios inspector of legal offices has been appointed to in
