It lias been brought to our attention that some area property owners are confusing the restricted area use b>'- law with the sub-division control by-law even to a point that they are one and the samne. Actually these are two different by-laws, , one already passed by Council and the other in the process of being passed having been given two readings. RESTRICTED AREA BY-LAW The restricted area by-law was passed by the Town- ship of Clarke on April 6th. However before it becomes law it must receive the approval of the Municipal Board. To obtain this approval certain conditions must first be met. One of these conditions is that every land owner in the Township and bordering areas must receive a copy of the by-law and are given the opportunity to file complaint against the by-law if they so desire. This bas been carried out b>' the Township and recenti>' land-owners did receive a copy of the by-law. The restricted area by-law, in our opinion, changes ver>' little as it co ntains chiefly conditions which had been wrongly placed in the building by-law. These conditions concern sncb things as size of lots, sideyards, and setbacks from the municipal roads and are presenti>' administered through the building by-law. The by-law does, however, provide a section which gîves control over what may be built upon land in the Township. The list of exceptions is, however, most extensive in this section and does not con- trol residential, or farm building in anyway. It does give control over use of land for industrial or commercial build- ings and here permission must first be obtained. SUB-DIVTSION CONTROL BY-LAW Sub-Divisîon Control by-law ,is the, other by-law; in question, and lias no relationship, witli the restricted area * by-law. .The sub-di, ision control. by-law is now before Councîl and lias received two readings. t is expected that * this by-law will come before council's next meeting for its third and final reading. The by-law would be effective throughout the entire Township. A sub-divi'sion control, by-law gives the Municipalit>' control, through the committee of adjustment, over sev- erances or dividing of land into parcels of less than ten acres. If land is to be divided into parcels of less than ten * acies then permission must first be obtained from the Coin- nmittee of Adjuistment, a local committee appointed by the Municipalit>'.i the case of a person wishing to purchase a bidn lot ofi 15,000 square feet fromi a farm it would be necesýsar ' to obtain. approval from the committee of adjust- ment. This by-law bias a definite purpose and does give the municipalit>' some control over development within its boundaries. Through the by-law, the municipality, through its Committee of Adjustment, may ask for proper plans of subdivision when land is to be sold for home building.
