A4 -The Oakville Beaver, Wednesday February 26, 2003 Environmental groups argue premature to plan for growth north of Dundas Street Town lawyer says previous development trigger is irrelevant (Continued from page A1) Among other things, that rul ing contained a "trigger" which stated 75 per cent of Phase II land (that north of the Q EW but south of Dundas) must be devel oped before building can com mence north of Dundas. In a lengthy and painstaking ly supported presentation, how ever, Ryan argued that this 25year old decision was made " irrelevant" as far back as 1983 when the Tow n updated its O P a situation only further cemented by the adoption of ROPA 8. And while the 75 per cent threshold still exists for residential land, she said there remains no such mechanism for employment lands. "A s of 1983, in my opinion, those decisions became irrele vant," said Ryan. Her presentation was also part lesson in municipal legisla tion. which explained how fluid OPs really are and how subse quent versions build on previous incarnations in order to meet updated needs. Unless Clear the Air can offer an "extremely persuasive" counter-argument, said Ryan, the issue should be struck from the formal hearing. Enough time and money has already been spent, she added. Lawyers for everyone from the Ministry of Municipal Affairs and Housing to the developers concurred with Ryan. In a response on behalf of Clear the Air. Rob Burton said he sees subsequent OPAs as con forming to the 1978 decision. He argued about the "prematurity" of growth without all the neces sary studies being complete. He then asked for time to formulate a better response. Ryan -- who said " we can all draft and draft and draft" -- pointedly asked if Burton had any facts to back up his position, especially since he has already had weeks to prepare. Speaking on behalf of Oakvillegreen. Michael Lansdowne mounted a more cogent defence of his position, starting with the fact that they do not question the authority of ROPA 8. Instead, Lansdownc main tains that the most recent popula tion and land use data indicate there's enough land available in Halton to accommodate growth for 20 to 30 years and that ROPA 8 doesn't specify a date by which development must occur. As a result, stated Oakvillegrcen's official position, the Town " has the obligation and authority to take a more restric tive position by taking adequate time to complete all the neces sary studies prior lo approving OPA 198." Lansdownc conclud ed by saying that OPA 198 is " premature and, by extension, bad planning." Before jumping ahead to determining how many people the land will support, Lansdowne said it would be more prudent to learn the subtleties and frailties of the land that is being consid ered. Only with such a " complete understanding," he said, can the process continue with "certain ty-" The pre-hearing continued Tuesday but ended after press deadlines. Issues to be argued range from the effect of growth on wastewater How and there fore algae in the lake lo transit and air quality. Halton Regional Police report that two teens were walking in the area of Dorval Drive and North Service Road when an angry man confronted them at 5:20 p.m. Police said the teens tried to ignore him and kept walking, but the man pursued the teens and stabbed one of them in the arm with a knife. The attacker fled the scene on foot. The victim was taken to the Oakville Trafalgar Memorial Hospital for treat ment and received 14 stitches to close a knife wound. Uniformed officers located a suspect in a nearby ravine and made an arrest without incident. During the follow-up investigation, police linked the suspect to an attack the previous day on two other teenagers in the foyer of an Oakville apartment. In that incident, police said a man approached two 15-year-old males at 1:10 a.m. and demanded money. When the teens resisted by saying they had no money, the suspect knocked one of the teens to the ground with a punch in the face. The teen was then forced lo hand over his ATM card and PIN number. The accused fled on foot. The victim was not seriously hurt and did not report the incident to the police. Charged in connection with both incidents is Donald Wilbert Burke, 21, of no-fixed-address. He faces charges of robbery, aggravated assault, assault and possession of property obtained by crime.
