The Oakville Beaver, W e d n e sd a y D e c e m b e r 10, 2003 - A 3 Town (Continued from page A1) the best interest of our community to do so," said McGinn, asking what Council was going to do, how it would keep residents informed and if it would move to purchase the land as open space. Such a recommendation was made by David Crombie's Royal Commission on lakefront regeneration in the 1980s. While the Region of Halton made inquiries about purchasing the land. Shell Canada, which owned the property at the time, didn't want to sell. The Tow n's Official Plan and zoning by law deem the property to be low density res idential to the west half and private open space to the east. Town planning director Peter Cheatley told Council that unless the Town is pre pared to buy the land deemed private open space, it is obliged to consider a develop ment application for the property. If the entire property were to be low' den sity residential. about 30 homes could be built there - 15 on each side. As it stands, Cheatley indicated that the apartment proposal would be tight on the property given that the developer must give 15 metres of lakefront land to the Town for the waterfront trail. Cheatley told Council it will take sever al months to get to the OMB pre-hearing conference stage and several more months to get to a hearing. "The Bronte area is one of the most beautiful areas in Oakville. It represents the history of Oakville and we wish to preserve our character for the future." said McGinn, nodng the Town's Official Plan should be sacrosanct. "Walking through concrete jungles of 25 storeys is not a legacy we want to give our children when they're accessing the lakefront." said McGinn. The resident told Council, the area's first preference would be to have the Town and other government levels buy the property as public open space. Oakville MPPand former Ward 1 coun cillor Kevin Flynn sent a representative from Queen's Park to indicate his support for the residents, which led Ward 6 Councillor Tom Adams to ask if Flynn, as Oakville's new provincial representative, would work to secure provincial funding to purchase the property. Mayor Ann Mulvale indicated the land would be expensive and called on the provincial government to honour its com mitment to establishing green space in the GTA. The mayor also called on the provincial government to get on its promised review of the OMB. Under the current OMB legisla tion, developers like Palm Place Developments can appeal within 90 days of filing an application - whether or not the application is "complete." "We need a definition of a complete application before the clock starts ticking at 90 or 180 days," said the mayor. The Province has talked about extending the deadline to 180 days - as it was prior to Mike Hanris' premiership. Outside the political realm, residents look to the podium one after another to tell councillors they don't want the apartment complex. Numerous residents groups from across Oakville also gave their support to the new Bronte group, including Joshua Creek Ratepayers Inc. (JCRI) president Rob Burton, who is currently challenging the Nov. 10 election results. "From our perspective, at the other end of town, we can't tell the difference between this and the Sharkey's proposal," said Burton, of a controversial development plan to pul a highrise where Sharkey's restaurant now stands. Residents were angry that a sign outlin ing the changes sought was required in July, but that it took the developer until Nov. 22. four days after it went to the OMB. to put up the sign. Cheatley said the Town can only keep asking the landowner to erect the sign on private property, which he said, the Town did. " Developers have been running roughshod over our community in recent years. Will it always be open season on our Official Plan?" asked Ken Forbes, of the West River Residents' Association. Resident Brian Bell said he and his fam ily first bought near the Petro-Canada refin ery and had to move knowing ihe refinery was there first. "This time that set of I .(XX) apartments is not there first and we will not be driven away this time," he said. Council voted to accept Monday's status report and after 90 minutes behind closed doors, unanimously voted to adopt a game plan. That game plan, however, wasn't made public because of its legal nature. Mulvale assured ihe crowd they had heard the message, but said Council could n't give away its hand and suggested there were probably developer representatives in the audience. "Sometimes we have to not give you information to further the message you're giving us." said the mayor. "Council has heard your delegations this evening and Council has listened to your delegations. In camera we gave a unani mous resolution directing stalf as to where and how to proceed." said Mulvale. The mayor said a pre-hearing confer ence date has yet to be set but that the Town would keep residents informed via e-mail as well as public notice. Mulvale said the Town would work with the new Bronte residents group and that in time that group "may wish to become a party to this appeal." 2 0 0 4 I O O E L S PURCHASE FINANCE 36 M O N T H S C 2 3 0 K om pressor Sport Coupe 5 3 9 9 / m o n th C 2 3 0 K om presso r C la ssic Sedan 5 4 2 5 / m o n th The December GladTidings, Great Savings Event.
