The Town of Oakville appreciates your feedback and ideas and we encourage you to get involved. You are invited to attend and provide input at this public meeting hosted by the Planning and Development Council, in accordance with subsection 17(15)(d) and subsection 34(12)(a)(ii) of the Planning Act, R.S.O. 1990, c. P.13, as amended. The proposed official plan amendment and zoning by-law amendment apply to all lands within the Midtown Oakville growth area, as shown in the key map, below. Official Plan Amendment The primary purpose of the proposed official plan amendment is to incorporate into the Livable Oakville Plan modifications to the text and schedules necessary to support the creation of new zoning for Midtown Oakville and implement recommendations of three studies, namely: Midtown Oakville Class Environmental Assessment (transportation and municipal stormwater networks), Midtown Oakville Parking Strategy, and Designing Midtown Oakville (urban design strategy). The proposed amendment also includes housekeeping modifications to the text and schedules that are technical in nature. Overall, the policy framework continues to support the long-term redevelopment of lands in Midtown Oakville in accordance with provincial requirements. The effect of the changes to the text will be to: introduce new policies related to transportation, stormwater management, parking , urban design, land uses, building heights, bonusing and implementation; clarify the intent of the policies; eliminate potential policy conflicts within the text; eliminate policies that are no longer relevant; relocate policies and reorganize selected sections; and, correct grammatical and clerical errors. The effect of the changes to the schedules to the Plan will be to: update the transportation network with new future and realigned roads, and active transportation infrastructure; redesignate a number of properties to reflect changes to the text and respond to changes to the road network; redesignate the lands designated Community Commercial on the north side of Cornwall Road, west of Morrison Creek, to Urban Centre; redesignate the lands designated High Density Residential north of the railway to Urban Core; and, apply a Utility designation to the existing utility corridor north of the railway. Zoning By-law Amendment The purpose of the zoning by-law amendment is to introduce new, form-based zoning to all lands in Midtown Oakville. These new zones replace the transitional zones in Zoning By-law 2014-014, both as amended with new use permissions, regulations, parking requirements, and holding provisions that have the effect of zoning the lands to permit redevelopment and intensification. The zoning implements the Livable Oakville Plan vision, goals, and policies for the area as proposed to be amended by the corresponding Official Plan Amendment. Specifically, this by-law amendment: replaces the current Part 7 (Midtown Oakville Zones) with a new set of use permissions, zone standards, form-based regulations, minimum and maximum motor vehicle parking requirements, minimum bicycle parking requirements, driveway and surface parking restrictions, and inclusion of provisions to permit bonussing introduces a number of new Special Provisions in Part 15 to recognize site-specific zoning permissions in Midtown Oakville introduces new Holding Provisions in Part 16 listing the conditions required for Holds applying in Midtown Oakville to be lifted replaces Map 8b in Part 19 with a new Map 8b with updated zone categories applying throughout Midtown Oakville introduces new Maps 8c and 8d in Part 19 to identify minimum and maximum height regulations and façade zone applicability in Midtown Oakville, and makes a number of technical additions and revisions throughout the by-law to give effect to the above amendments and recommendations of the three Midtown studies Appeals If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Oakville before the proposed Official Plan Amendment is adopted or before the by-law is passed: a) the person or public body is not entitled to appeal the decision of the Town of Oakville to the Ontario Municipal Board; and b) the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so. Any submission to the Planning and Development Council, either in hard copy or in electronic format, must be forwarded to the Clerk's department for receipt no later than noon, May 27, 2014 to ensure its availability to the Members of Council at the public meeting. Individuals making oral submissions at the public meeting are requested to submit a written outline of the submission to the Town Clerk. All submissions should include the full name and address of the presenter.
