Burton Bros. of this town sued the Playfairs, of Midland, to make them purchase certain timber berths in the Townships of Lount. Mills and Pringle. in the District of Party bound, for $45,000. The defendants raised the plea that there were misrepresentations, but in the trial the plaintiffs were given judgment by Chancellor Boyd. The defend- ants then appealed to the Court of Appeal and lost, as will be seen by the following judgment, given out on Friday at Osgoode raised on the ground of misrepresentation were not supported by the evidence ; that the contract satised the Statute of Frauds; that there was proved a consensus of the parties for the sale at the price. suicisntly manifested ; that the letter of 20th Septem- ber, l900, from defendant. was a proposal to buy, and an offer of $45,000 cash, and was accepted by plaintiffs on 3rd October ; and the letters of defendant. dated 21st September, 4th October, 7th October, and 23th and 19th October. were cogent to show that the rst letter was considered to be -a cash offer, and that the contract was carried out on that footing.
