'Don t go and t _ot for the want of a light weight coat You can get. one for 90. 1 at Cashman 8: Pa , 1 On Monday, Judge Boys had a special sittings of the Division Court to hear the de- fence put in by the corporation of Barrie against Mr. Henry Bird to recover several hundred dollars, the amount of some 127 a claims for alleged discrepancies in the police court accounts during the last nine years the defendant was police court clerk. The ap- ` pointment of police magistrate dates from nine years previous to January. Mr. Bird. i in his examination by Mr. Hewson, counsel 1 for the town, said that he had kept a _com_- plete record of police.court business in the`, book of convictions. He might have com- ; mitted errors, b_ut._ so far as he knew the record was correct On the back of every information is endorsed a record of the nes, 1 costs, etc.. in connection with the case to which the information pertains. This record should correspond with the record in the book of convictions. As the various 127 cases were proceeded with it was evident thatthe two records did not agree. Many discrepancies were noticed, which Mr. Bird acknowledged, but was unable to account for from his memory of the individual cases. As to the payment of witnesses` fees Mr. Bird said he had' always paid` all such fees as were demanded, payment being made direct to the witness or to witness through some constable. He had always taken the court costs himself, as he was entitled to them. At the time the police magistrate was appointed the latter had arranged with the witness to take the court fees in consid- eration of assisting him (the police magis- trate) ,in police court work, this arrange- ment having been made before the police magistrate "tried his first case upon assuming oce. Witness said that upon the appoint- ment of police magistrate being made, Mr. Pepler, who was.-thg._n_. mayor, announced to the council that the'..tgown would from that time not receive fees from the police court, the implication to the witness being that the police court clerk was to get the fees there- after. Here Mr-. Hewson produced a letter from the police magistrate to the council of 1897, asking for a salary. In the letter was a statement that the police court` clerk was receiving the police court fees as an oicial of the town. Frank Carpenter, who could not remain until Mr. Bird had nished, swore that he had been ned $5 and costs for a certain oence, but had never paid more than $5 and had not been requested to do so. Detective Beardsley, who had to leave also, said that he as game warden had secured a conviction of $5 and costs against a person for breach of game laws, but had not received anything. Mr. Bird then con- tinued his evidence. He offered the follow- ing rebuke to Mr. Hewson : You have had detectives and accountants and sharpers looking over these books for nine years back and `no doubt you have discovered some- thing. Councillor Love scored Chairman Soules for allowing any Councillor to dictate to him. Caldwell -Did Council authorize that work ? -The work comes under the head of re- pairs, it is not new work. Love-I asked for the sidewalk because I considered it a repair job. Bennett-Am I to understand that any Councillor can ask the Chairman of Works to lay or relay a sidewalk? Mayor -While it is not_a rule of Council, there is still an understanding that Chairmen of Committees are allowed to use their discre- tion in expenditures not exceeding $10 ; de- lays are thus obviated when immediate re- pairs are necessary. Councillor Bennett backed by Deputy-Reeve Caldwell then pro- ceeded to score committee for expenditures not authorized by Council. He said Me- Carthy s hill had been gravelled or sanded, Bayeld street south had. been boulevarded, and Essa Road expenditures had exceeded the appropriation, and all without the au- thority of the Council._ Out of the $4,000 spent every year by the Works Committee. $1,000 or $1,500 should be spent in permanr ent road or sidewalk improvements. Since that time ove $800 has been spent by the trustees in pu ting the building in a perfect sanitary state, and in the purchase of the many appliances required in a modern hospi- tal. In addition to this large sum the sev- eral churches in the town each undertook the furnishing of a ward, and one of them furnished the operating `room and the main entrance hall. Our late member, the .la- mented J) Alton McCarthy. most liberally presented the hospital with an operating table, equipped with all the modern im- rovements. Mr. McCarthy had always een a staunch friend" of the institution, and the loss will be severely felt by the hospital, as well as by every charitable institution in the county. Other largesubscribers to the funds have been Mr. Whitcher, of Galt ; Mr. 1).
