AL_ ___,_,_,, ,-.,, `A1 the York in` T_orout:J last week, one of the triedlwaa that of John McGibbon vs. norm Patterrson, _ both of thetownship of Mono, for dam- i . ages, in consideration of injuries inicted ' by deft upon the left hand of pl`, by a. bite. The case occupied a long time, there being agreat many witnessesa for each side. The facts appeared by the evi-, dence that `there had been some cause of jealousy between the men befote the day in question, but on this occasion some trotting races were beingheld on a side line and the plaintiiiwho was return- ing home in his waggon after having been . engaged in drawing railway ties, stopped to witch the sport; After the trotting was over the two "men got into their several vehicles to return home, when some diiculty occurred as ~ to where some future race was `to be held. They then descended. threw off their coats, and clinched. _ During the scuttle, as the plaintiff claimed, his opponent en- deavoured to bite his face, but he put his hand up and tried to push him away. The defendant got the other s thumb in his mouth and bit a piece clean out, be- sides effecting another wound on. the side of his hand. These injuries had prevent ed him from working for about three months, and from lling a contract he had made with a man to do some work, and for this loss he claimed compensation. The defence claimed. however, that pro- vocation had been given by McGihbon himself, and that the defendant had` bit- ten him in order to prevent him gaug- ing him. After a long deliberation the jury brought in a verdict for the plain- tiff, damages being placed at $5. _ Sons of our Mnskolm readers may be interested in a case, Mitchell vs. Duff, which` was tried at Hamilton (Went worth Co.,) Assizes last week. ' The action, which is said to be one of the most extraordinary lever brought into court, was for seduction-the fact being that the plaintiff who is the father of Amelia Du'-who is the wife of the de~ fendaiit William Du` -brought this ac- tion against his son-in-law, alleging that _the marriage of his daughter to Duff was , illegal, as Duff had at the time of his marriage another wife living in England, as the plaintiff alleged. The facts proved !were that Duff and Amelia were law- ` fully mari-ied in Hamilton in 1871, and 1 from lillttt, time until May 1878, _lived to- I gether as man and wife ; and three child- l `ten had been born to them; that for` . several years they lived in St. Cathar: , I ines and afterwards moved up to Musko- ' l lra, where he took up land. They lived ` `there several years, when, the wife left; her husband and children and came to .St. Catharines. There she employed a lawyer to le a bill in Chancery for ali- i mony, and she succeeded in getting an n i order for that purpose, but when hei- I I solicitor went to search up D118` s land 1 he found, that to be even with his wife, he Duff had made a deed in trust of his land in St. Catharines for. the benet of a woman and her child, who he called his wife and child, in Englaiid,-with a proviso, however, that he could revoke the deed at any time. Finding this deed, the wife then prosecuted for bigamy. A ; constable was sent to Muskoka and Du` was arrested and brought to Hamilton, and after lying in jail forseveral months, ' was tried and convicted of vbigamy; This l conviction was afterwards quashed and 3 Din} liberated. '_l`lien the father (Mitchfl ell,) brought this action to recover ! damages for the seduction of his daugh ter.. It appeared that the daughter had 1 not been under her father's care for ' twenty years ; that she had been obliged to look out for herself since she was seven years of age, and that before she married Duff she had an illegitimate . child to some other man ; that no action had been brought for that seduction. ' l ..A communes game was cleverly r played on a Muskoka man in Toronto on Friday The Telegaam gives particu late: Mr. James Armstrong, the victim ' of thecondence operator, who keep: a store with his brother in the township of McKellar, Muskoka, arrived in.the city a few days before, and, having com- ` pleted his business, started for home. Upon arriving at the Northern Railway. station at seven o'clock, he found that the train did not leave for half an hour, 4 and in order to spend ' the time pleasant- , -ly, got into conversation with two strangers. At train time he purchased * his ticket and stepped on to the train, being followed by one of the strangers, who called Mr. Armstrong aside and said he was goingas far as Gravenhurst, but, unfortunately, he had not sufficient 3 cash to buy histicket; would Mr. Arm- strong kindly lend him ` some on a cheque on the Bank `of Montreal, which ' he had in his "pocket? Mr. Armstrong enquired what amount would suit, but when the stranger asked for only $400 the victim hesitated. ' The wily : swindle: saw that he had bid too high, and hastened to explain that $160 would do, and that Mr. Armstrong would cash the cheque and take out his money when they reached `Barrie. Thegqggent and verdant store-keeper, without further H hesitation, produced his pocket book and ` paid the stranger 3169, taking in ex- change the cheque on the Bank of `Mon- treal, which was an order for $5.00. The choruses from Mozart s Twelfth Mass, which have been the chief subjects of study, are now rendered bythe society witha precision which would do no `discredit to more pretentious organizations. It has been decid- ed to give a concert on the. '30th of the pre- sent month, at which, in addition to the choruses a number of qunrtettes and solos will be givcn_by our best amateurs. The prices. of admisslon will be placed at a popular hgure, ' the only object being to defray the necessary expensese of the society, and we therefore hope to see a crowded house, and such an ap- preciation of the ebrts of our amateurs as W111 encourage them to give a second concert be- tore the winter is over. on l .--.;_. -Hamilton grain buyers are evidently not so staid and. circumspect in their conduct about the market as are Barrie buyers, to judge by the following account of the doing: of one of them, as given in the Spec. :-A new buyer in the grain market in his leisure mo- ments amuse: himself by cutting slabs out of the snow, and stickiu them up on end, in which position they e osely resemble slabs of marble.
