The child has a disability and the Halton District School Board (HDSB) agreed to add a bus stop closer to the family home. On Oct. 16, the board amended its existing transportation policies to accommodate parents with similar needs for their children. "The Halton District School Board has consistently considered the needs of students in the delivery of its programs," said David Euale, board education direction in an email to the Oakville Beaver. Euale declined to reveal in which part of Halton the family resides. As a result, the board now recognizes that it might be necessary to alter transportation services as a result of safety or operational concerns or to accommodate valid needs of students and parents in connection with their race, ancestry, place of origin, colour, creed, ethnic origin, citizenship, creed, sex, sexual orientation, gender expression, age, marital status, family status or disability. "It is as a result of a mediated settlement with Human Rights that we have been dealing with," Euale told board members on Oct. 16 at a Halton District School Board meeting. A Human Rights Tribunal of Ontario made a rare interim decision last February -- while it was still dealing with the complaint -- when it ordered Halton Student Transportation Services to pick up children closer to home. "The loss of a year of Junior Kindergarten or unnecessarily missing portion of Grade 2 is something that can never be replaced," tribunal Associate Chair David Wright wrote at the time. The mother, whose identity is protected along with the identities of her children, received legal support in her application from the Human Rights Legal Support Centre. "We hope that school boards and school transportation authorities across the province will follow Halton's lead," said Clara Matheson, the Centre's lawyer in a news release of Oct. 16. Ontario Human Rights Commission Chief Commissioner Barbara Hall praised the settlement. "Students across Ontario have the right to use school bus services without discrimination because of disabilities or other Code-related needs that they or their parents or guardians may have," Hall stated in a news release.
