Toronto solicitor Joseph Castrilît camne before the Ontario Municipal Board and Environmenta Review tribunal Monday and Tuesday to present hîs final arguments against the potential expansion on behaîf of the Coalition on the Niagaea Escarpment (CONE) and Protect our Waîer and Environment Resources (POWER). Tbe joint board will decîde whetlter or not the 85-hectare quarry extension pro- posai, which straddles the Mîlton/Halton Hîlîs border, will go ahead. Mr. Castrilli presented tbree days worth of technical evidence and arguments on issues sarrounding everything from water 10 the nataral envirooment. He spent a lot of time revîewîng the potential impact the quarry expansion could bave on the Jefferson salamander, a rare species that's found in the Halton Forest and surrounding area. He said the salamander could attempt to migrate across an open field found in the quarry expansion area and the alteration or removal of Ibis migration route could severely impact the population of the national ly-threatened, animal. "The evidence in nue suhmission is hoth persuasive and overwhelming that Jefferson salamander migration route stad- ies shoald have been, but were not donc in the open fields," he told the board. "Unless you do the study, yoa'll neyer know." Dafferins lawyer Jonathan Kahn earlier argued that experts hîred by the aggregate company said salamander migration across open fields is atypical and any relaîed stud- tes would be 'unnecessary and unduly onerous." M. Casîrilli also heavily critîcîced Dufferin's position that there's a large need for the expansion to meet the demand for crushed stone. Mr. Kahn prevîously told the board that the existîng Milton quarry is expected to be mined out by 2007, maktng timing critical. He also said that 30 to 40 per cent of crushed stone production in the GTA comes from the Milton quarry. "The applîcant s evîdence on the need for 10 to 12 more years of aggregate is neither so strong, nor so convincing, that the com- pany should be allowed to excavate anotb- er large chunk of wbat makes the Niagara Escacpment su unique," Mr. Castrilli saîd. "Extraction reduces a natural resource that cannot be replaced." The enviroumental monitoring plan, known as te Adaptive Environomental Management and Protection Plan (AMP), was another aspect of Dufferin's applica- taon that came under fine. The document stipulates that Duffermn must cease extraction if the AMP ix not effective in raixing groundwater levels above target. But Mr. Castrilli noted that "ceaxe extraction is not as draconian a club for compliance as the appltcant makes it out to be, particularly if you are an on-site wet- land."
