The Canadian Champion, Tuesday, November 11, 2W03--9 /Lega1 opinion on bike Haltrin app1'ing for 311 ,aecess path expected soon By JASON MINER The Champion A legal opinion could corne aa early aa tdûs week that could determiine the fate of a controversial bike path in the Hawthorne Village subdivision. A lawyer is examinisag the legalities of the Town posaibly having the paved bike path re-located or redesigned. 'Me Town haa aaid the bike path is part of an agreement signed with Mattamy Homes, thre atill-owner of the three-year- oldsI ubdivision, before houamng construc- tion waa allowed to start a couple of years ago. "If we change it or delete it, what are we opcnmng ouraelves up to?" aaked Paul Cripps, Milton's engineering director about what the legal opinion will detail. He aaid it could show what liability issues the Town might face if il doesn't put in a bike path. "It's a matter of risk asseasment." The bike path has become a sensitive issue because Mattamy had plans to build a controversial $125,000 paved path that many reaidents vehemently opposed. It waa proposed to rusa between boulevards - open pieces of land in front of homes - and would cross residents' driveways. Homeowners - some saying they knew nothing about it when they bought their home - argued the type of path devalued their homes and was too unsafe because it would bisect driveways. The complaints eventually forced the Town to send a letter in mid-September to Mattamy instructing themn to halt construc- tion of the bike path. Mn. Cripps said the Town will hold a Millennium garden now has a sign Halton Region Chair Joyce Savoline congratulated staff on the placing of the 'Halton' namne on the wall of the new mil- lennium garden, as the firat phase of the project nears completion. The garden is located on the west lawn of Halton's headquarters at 1151 Bronte Rd. in Oakville. The Halton Millennium Garden was pro- posed by Halton staff in 1999. The firat phase of the garden includes tht signature piece - a raised bed and atone- wall backdrop with the word 'Halton' fac. ing Bronte Road in large copper letters. This phase also incorporates a largi water feature that represents the signifi cance of Lake Ontario and the many water sheds within the region. Subsequent phases of the garden will 1b developed as fundraising and additions sponsorships permit. Potential sponsors interested in becoru ing involved in any aspect of the garde project should contact Carolyn Calwe] sponsorship co-ordinator, at (905) 825 6260. "We want to get feedback and bo hear what they have to say about the issue," hie said. Rob Desiauriera, a Waldie Way resident in Hawthomne where part of the bike path was to go, looks forward tothe legal opin- ion. 111 think what's juat as important is what the legal ramifications are if they do" go ahead wîth the paved bike path, hie said. Regardless, a potential path won't be built in Hawthomne until at least next spring when the weather warms up, Mr. Crippa said. A Mattamy representative coutdn't be reached for comment.
