As the season wraps up, this weekend is the Iast chance ta pick your own strawberries at the Bell Schoal Line farm. Judge says Exxxoicajàlls wiîhin deinition of retail store and is permi tîed use under municipal hylaw, By JASON MISNER Thie Champion Exxxotica is staying right where it is. A ruling by Ontario Superior Court Justice Christopher Speyer, released pub- licly ai Monday nigbt's town counicil meet- ing, stated Exxxottca Adult Video can legally remain at tts Bronte Strcet South location. "Il is my view that the respondent opera- tion clearly falîs wiîhtn the definition of a retail store and is a permttted use under the terms of the bylaw," he said ut the ruling. Exxxotica, which opened tn April 2002, seils and rents adult videos as well as offers for sale sex toys, magazines, candles and lingerie. Store owner Tony Wang told The Champion he's relieved by the decision. "1 feel happy. Now l'm trying Io work witb the Town." The Town stanied pursuing the legal issue of baving the store relocate about seven montbs ago, said Town clerk Troy McHarg. Exxxotica's location conundrum was a main driver in the Town passing earlier Ibis year comprebensive legislation that dic- tates wbere aduit entertainment businesses can locate in Milton- an industrial area north of I-by. 401 - and the legal require- ments needed to open. Mr. McHarg said the Town was attempî- ing to get Exxxotica relocated to what offt- cials felt was a more suitable location at the Hwy. 401 industrial area. "Obviously, wc were overruled on that rone," he said. TMe Town will work with Mr. Wang to ensure he's properly licenced under the new bylaw for adult videotape stores, Mr. McHarg said. The bylaw requires signage on the store entrance spell out the words "licenced adult vidco tape store" and that store signs don't show specified body parts. The Town was also ordered by Justice Speyer to contribute $6,000 toward Mr. Wang's legal fees. Mr. Wang wouldn't say exactly boss much he's spent on legal fees but that it's exceeded $1 0000). Residents and politicians \weren't thrilled with the ruling. Six-year Bronte Street South resident Josi Mulet said she has had trouble renting out a room in her home because potential tenants have expressed conccmn about Exxxotica being located across the street. "Il also lowers my property value," she said. Wards 2 and 4 Regional Councillor Rick Malboeuf said he's disappointed with the decision. "The judge bas ruled that the bylaw that was passed many moons ago was vague. There's flot much else we can do." He said he expects the new legislalion regarding placement of adult entertainiment businesses will help curtail these kinds of future problems.
