Folowing a Town staff review of the controversial 5-4 vote against reconsider- ing the smoking bylaw, it's been deter- mined the vote was flawed on several lev- els. Under the miles of order, a motion to reconsider the smoking bylaw - made by Councilor Rick Day- was out of order and shouldn't have inspired a council debate and vote. "This reconsideration motion was brought up and procedurally, that shouldn't have been allowed," said Town Clerk Troy McHarg, who joined the Town's staff days after the vote in question. As someone who voted in faveur of the current byIaws. Mr. Day would've had the ahility Io move reconsideration, but oniy during the April 22 meeting as which the hY1va wsas originalv appros'ed.
