In a judgement handed down last Friday. Justice J. de P. Seabom of the Ontario Municipal Board (0MB) said the strip club doesn't violate munici- pal. regional or provincial planning legisiation. Therefore. according îo the ruling, a zoning ameodment for the property should have been granted by the Town when it was first sought in 2000. During a two-day hearing in April. the Town argued the location was unsuitable for an adult entertamrment parlour because Steeles Avenue is a gateway to the community. Resîdential develop- ment mn the surrounding area is also planncd. the board was told. But in its judgement, the board said the location isn't part of the central business district and is sur- rounded by industrial uses. The Town bas 30 days from the date of the dcci- sion t0 file an appeal to provincial cabinet. "We feel sindicated- we're excited. We had donc our best to select a carelul site that bad con- sideration of our neighbours and the tosso as a whole," Mr. Starr commented. "We know our business is conitroversial, but it is our goal to mun this business as non-controversial- y as possible:" Before construction of thc new club can begin. site plan approval and building permits are still needed trom the Town. Mr. Stanr said he expects those applications to be fled within 60 days. A business licence will also be required before the club opens. Fellow ward two councillor Wally Hunier expressed disappointment with the 0MB decision. He said the hope now is that the strip club won't see enough business to stay opcn for a great length of ime. I don't think anyone is going to bc very happy about thîs. It's not my idea of the kind of business you want to have in a small town like Milton," he said. "Peuple are forcing this down the Town's throat, saying there's a constitutional right to operate a butsiness. This is something w.. (council) should have total control over.
