The owner of the taverni bas appealed a 2000 decision by town counicil nixing plans to open the club to the Ontario Municipal Board (0MB). A board verdict is expect to arrive in the coming weeks. "The only issue before the court is whether this is an appropriale site," David Starr, solicitor for the club owner, told The Champion. "We argue this is an appropriate site because it allows us to bave a minimal impact on tbe community. The site is sep- arate from sensitive uses like churches, parks and schools, it is flot downtown, it is flot in a residential area. Tbe site is in effect an mndustrial area." The Town defended council's decision during the Marcb 25 and April 3 0MB hearings witb two major arguments both countering the appellant's belief the location won't bave an impact on the community. 'We really couldn't argue morality, because obviously that's a federal juris- diction and it's flot something to be con- sidered under the Planning Act," explained Mcl lovio, Milton's director of planning and development. While the site is currently zoned as an industrial business park, the Town's offi- ciaI plan calIs for the ares to become a high-pedestrian location. A planned trails network and Chris Hadfield Park are expected to make the area a tourist desti- nation. PResidential development is also planned within the surrounding area. "It's flot anything the officiai plan would put a time frame to, but it's in there," said Mr. Iovio. The club also sits along a secondary gateway into town, which bas raised some concem. -It's going to bave high visibility is the issue," Mr. tovio continued. "Those areas (gateways) get a littie bit more attention in termns of streetscape to create an image of the community for people coming into the community."
