He told me if I sent bim more furniture, be would be able to gel lIse down payments from customers and would be able t0 psy. t was surprised - most people would be apologetic. but be said ter send more fumniture." tn 1999, Mr. Vokes testified, bis store received several returned cheques from, tbe bank for lack of sufficient funds from tbe Village Pisse Sboppe. He continued bis testimony in Burlington cousrt last Fniday and told tbe court tbrougbout 1999 bis business contin- ued to accept cheques fromr tIse Village Pine Shoppe and continued t0 deliver to tbe store because operators wanted tbe money 10 pay down thse accourt. "It was important t0 us t0 collect tIse funds," be said. Mr. Vokes continued bis tesîimony in Burlington court Tuesday and testified tIse last time be spoke t0 Mr. Currie was over the phone Ibis past January. "He seemed in a panic. He said be want- ed as mucb fumnilure as we could give Isim but be didn't pusb Isard. Normatly be was assertive but tbis lime be seemed distant. I asked if Ise could pay and Ise said be had no money. So basically I told bim no money, no fumniture." During cross examinalion, defence lawyer Antbony Bryant suggested a lisse of credit bad been establisbed between Frontier Fumnilure and the Village Pine Sboppe, ter wbicb Mr. Vokes disagreed. "It was our understandissg tbat Our driver would receive a cheque fromr tIse Village Pine Sboppe upon delivery or we wouîdn'1. deliver." Mr. Bryant poissted out no wbere on any document did it say fumniture wouldn't be deîivered until the amount owissg was paid. He also suggested a delivery lime of one montb ftom Frontier Fumniture to tIse Village Pisse Sboppe wouldn't be unrea- sossable. "As our business was expanding, the prediction of a delivery date was less cer- tain," Mr. Vokes said. "But the only recol- lection I bave of an exîended delivery lime was in July of 2000, wbess il took 10 or 11I weeks for us te, deliver.
